Johnson Memorial Hospital (Hartford, Connecticut) Consultant and expert witness for Attorney Stephen Seligman who represented the family of a young brain dead woman. Hartford Superior Court Judge accepted the position that the physician should make the appropriate medical position in such a case. Respirator was removed. (March 18, 1981). 2. People v. Barber & Nejdl (Los Angeles, California) Consultant and expert witness for Attorney William Gargano in defense of two Los Angeles physicians charged by District Attorney for withdrawing IV treatment from irreversibly brain damaged comatose patient. The charge of murder was dismissed by the California Court of Appeals (1983-1984). 3. In re the Estate of Earle Spring (Massachusetts) Consultant and expert witness for the plaintiff on an invasion of privacy breach of confidentiality suit against the Holyoke Geriatric Authority by the widow of Earle Spring. Award of $1,000,000. (Massachusetts Superior Court, August 1983). 4. In re Douglas Firestone (Long Island, New York) Consultant and expert witness for the Guardian ad Litem in the case of a brain dead 21 year old being maintained on a respirator against the family's wishes. Patient had cardiac arrest. Pronounced dead before disposition of the case. (State Supreme Court of Nassau County, New York, September, 1983). 5. In re Baby Jane Doe (Long Island, New York) Consultant and requested to be an expert witness by New York State Attorney General's Office. New York Court of Appeals, Federal District Court and 2nd Circuit Court of Appeals. All of the courts ruled in favor of the State Attorney General's position. (October, 1983-March, 1984). 6. In re LaGuardia Hospital (Queens, New York) Consultant and expert witness for the Deputy Attorney General for Medicaid fraud before the New York Grand Jury investigating "Do Not Resuscitate" Policy in the state institutions caring for Medicaid patients. (December 14, 1983). 7. Riverside General Hospital v. Bouvia (Los Angeles, California) Asked by her attorney to testify on behalf of Elizabeth Bouvia, the 29 year old quadriplegic who wanted to starve herself to death under medical supervision. Since I believe Bouvia's stand violates theological and ethical standards, I declined. The California Superior Court and State Supreme Court ruled against her petition. (January 1984). 8. California Board of Quality Assurance v. Lappin (California) Consultant and expert witness for California surgeon charged by the State Medical Society for practicing below community standards for regularly operating on Jehovah's Witnesses without use of blood. Charges dismissed. (June, 1984). 9. Brophy v. Mt. Sinai Hospital (Boston, MA) Consultant and expert witness for Attorney Frank Reardon who represented the wife in a petition to remove feeding gastronomy from a 48-year old patient in a persistent vegetative state. Supreme Judicial Court reversed trial court and authorized removal of feeding tube. (nine-day hearing in Massachusetts Probate Court, May, 1985).

Engelwood Hospital (New Jersey) Consultant and requested to be an expert witness by Attorney William Strasser in a malpractice suit against New Jersey physicians and hospital who refused to remove a respirator without a court order from a 91 year old stroke victim despite a neurological diagnosis of "nearly brain dead." (February, 1986). 11. Jobes v. Parkland Nursing Home (Morristown, New Jersey) Consultant and expert witness for Attorney Paul Armstrong who represents family wishing to terminate feeding jejunostomy on thirty year old Nancy Jobes who has been in a persistent vegetative state for five years. Authorized by New Jersey Supreme Court. (Morristown, New Jersey Superior Court, March 17, 1986). 12. Gray v. Romero (Providence, Rhode Island) Consultant and expert witness for Attorney Linda McDonald, lawyer for family of Marcia Gray, a 49-year old woman in a persistent vegetative state. Rhode Island Federal District Court ordered removal of nutrition and fluids. (January/June 1988)/ 13. McConnell v. Beverly Enterprises (Danbury, Connecticut) Consultant and expert witness in Danbury Superior Court for Attorney Edward Weiss, lawyer for the family of Ellen McConnell, a 49-year old woman in a persistent vegetative state. Connecticut Supreme Court ordered removal of nutrition and fluids. (June 16, 1988). 14. Board of Registration in Medicine v. Bothner (Massachusetts) Consultant and expert witness for Attorney Christopher Nolan, lawyer for Dr. Bothner, a physician charged for writing a DNR order on an incompetent patient without known family and without prior court authorization. Board of Registration dismissed charges. (September 20, 1989). 15. Adams v. Frumovitz (California) Consultant and expert witness for Attorney William Gargaro who represents plaintiff. Issue is matter of informed consent in case of toxoplasmosis (October 22, 1991). Verdict for defendant. (October 25, 1991). 16. People v. Reilly (Denver, Colorado) Consultant and expert witness for Attorney Richard Vermier who represents Patricia Reilly, a nurse accused of attempted murder for shutting off the oxygen on patient in final stages of dying. Nurse acquitted of felony charges. (December 18, 1991). 17. Ashcroft v. King (Santa Monica, California) Consultant and expert witness for Attorney Robert C. Baker of Baker, Silberberg & Keener in the case that involved a surgeon's failure to guarantee that only donor related blood was used for surgery. Patient contracted AIDS from general donor blood. Pre-trial settlement. (May 1992). 18. Burns v. Kaiser Hospital (San Diego, California) Consultant and expert witness for Attorney Sydney Merritt of Baker, Silberberg & Keener who represented the defendant, Kaiser Health Plan. (Issue: Did the hospital fall below the standard of care in using a physician's assistant to examine patient presenting with "flu." After a full trial the court found for the defense. (August 17, 1992). 19. Estate of Ramirez (California) Consultant and expert witness for Attorney John E. West of Beam & Brobeck who represented Orange County California in a case involving the removal of the heart for transplantation from a "John Doe" who was brain dead. The family subsequently sued for failure to obtain their permission prior to the transplantation. Case settled before trial. (February 5, 1993). 17
20. Williams v. Chicago Osteopathic Medical Center (Chicago, Illinois) Consultant and expert witness at trial for Attorney William V. Johnson of Johnson & Bell who represented the physicians in a case involving a newborn pronounced dead at birth who was discovered an hour and a half later struggling to breathe. Nothing further was done till four hours after birth when, still struggling, the infant was placed on a ventilator. The infant died several hours later. The jury found for the defense. (March 9, 1993). 21. Gammon v. Kryger (Boston, Massachusetts) Consultant and expert witness for Attorney Christopher Nolan of Warner & Stackpole who represented a nurse in a civil suit charging breach of professional confidentiality. The nurse had revealed the blood alcohol reading of the plaintiff to the police who were investigating a vehicular homicide case. Case settled on eve of trial. (March 24, 1993). 22. Shah v. Kaiser Foundation (Los Angeles, California) Consultant and asked to be an expert witness by plaintiff Attorney Christopher P. Legel of the Law Offices of Daniel M. Harney in the case of a physician who alleges she was dismissed for her refusal to provide pre-signed prescription pads for the nurse practitioners at a Kaiser Permanente facility. Declined to be a witness. (October, 1993). 23. Hagelberg v. Santa Monica Hospital (Santa Monica, California) Consultant and expert witness for Attorney Melissa S. Fink of Baker, Silverberg & Keenen who represented the physician in a case of a patient who had refused continuous fetal monitoring and then delivered a seriously compromised infant. She is suing physician for failure to protect fetus. Case settled. (May, 1994). 24. Bain v. University of Miami (Miami, Florida) Consultant and expert witness for Attorney Christopher E. Knight of Fowler, White, Burnett who represents the University of Miami in the case of a 16 year old woman who delivered a live profoundly compromised fetus after an attempted abortion. Charge is that physicians breached responsibility to immediately resuscitate the non-breathing infant who later breathed spontaneously. Jury found for the defense. (May, 1994). 25. In re Baby "K" (Fairfax, Virginia) Consultant for Attorney Julia Krebs of Hazel & Thomas, who represents Fairfax hospital in the case of an anencephalic infant whose mother demands aggressive ventilatory support for the infant. A federal district court and the Fourth Circuit Court of Appeals ruled under the Emergency Medical Treatment Act that the hospital must, if requested, "stabilize the infant." (May, 1994). 26. In re Gerber (Hanover, New Hampshire) Consultant and expert witness for Attorney Peter Mosseau of Nelson, Kinder & Mosseau who represented a physician being investigated by the Attorney General's office for participation in physician-assisted suicide. Grand Jury refused to return a "true bill." (January, 1995). 27. People v. Messenger (Lansing, Michigan) Consultant and expert witness for Attorney Frank Reynolds of Reynolds, Guyselman & Casey, who represent the father accused of homicide for removing his 25 week gestational age son from a ventilator. Jury verdict: "Not Guilty." (January, 1995). 28. Gilgunn v. Massachusetts General Hospital (Boston, Massachusetts) Consultant and expert witness for Attorney Frank Reardon of Hassan & Reardon, in the defense of an intensive care physician and the physician chair of the Ethics Committee of Massachusetts General Hospital for the writing of a DNR order and the removal of a ventilator from a dying patient against the family's wishes. Jury verdict: "Not Guilty." (January, 1995) 18
29. Romona Osgood v. Genesys Regional Medical Center (Owosso, Michigan) Consultant to Attorney Clark Shannon of Owosso, Michigan who represents the guardian of Brenda Young in a "wrongful life" claim. Plaintiff believes the physicians acted against the daughter's Advanced Directive when they instituted ventilatory support that has now left the daughter in a persistent vegetative condition. After a review of the record, I told the plaintiff's attorney I did not find anything wrong in the way the physicians handled the case. (January, 1995). 30. O’Neill v. Miles, Inc. (San Francisco, California) Consultant and expert witness for Attorney Janet Grove of San Francisco who represents the defendant manufacturer in the case of a physician who recapped a needle after drawing blood from a known terminally ill AIDS patient at the patient’s home, put the recapped needle into a paper bag along with the drawn blood, tubing, etc. and then without looking into the bag later put her hand into the bag and stuck herself with the needle.
