Preli

investigation revealed American forces raided . the residence of the wilily and alle edl took 80,000 U.S. Currency, 30 million Iraqi Dinar, gold, and jewelry. The ales further alleged they were all transported to the Ruthwania palace, where they were kicked, punched, threatened, and had dogs biting at their clothing on numerous occasions while at the palace. Investigation by this office and review by Headquarters (HQ), USACIDC, determined there was sufficient credible information to believe the offenses of aggravated assault, and cruelty and maltreatment, did not occur as alleged. Investigation determined theMIR males were captured on 24 Dec 03, by members of the 1st Battalion (BN), 3rd and 5th Special s (SFG). Meinbers of the capturing units were interviewed and related the males were captured without incident and taken to a Temporary Screening Facility (TSF) at Ruthwania palace, IZ, where the detainees were processed, initially screened, and interrogated. The detainees remained at the TSF for approximately two days before being transferred to the Baghdad Central Confinement Facility (BCCF), Abu Ghraib, IZ (AGI), by members of 5th SFG Dec 3. All personnel interviewed denied abusing or witnessing any abuse of the family at the time of their capture, or during their detainment at the TSF prior to being transferred to the BCCF. Available medical records pertaining to the detainees were reviewed and there were no injuries noted on the medical records consistent with their allegations of abuse. Interviews with the capturing unit personnel confirm there was approximatel $72,900 cy and 32 million Iraqi Dinar confiscated from the o e of the amily and turned into the TSF when the were in-processed. Interviews with unit personnel identified SSG as the person responsible for document' oney and ensuring it was transferred with the detainees to the BCCF. SSG was interviewed; however, he invoked his legal rights and did not provide either a written or verbal statement. Documents recording the seizure of the money and other property from th amily residence were never located. This investigation was coordinated with MAJ Staff Judge Advocate, 10th SFG, United States Army Special Operations Command, Forward Operating Base (FOB) Central, Baghdad, IZ, who opined there was no probable cause to believe the offenses of aggravated assault and cruelty and maltreatment occurred as alleged; therefore, they are unfounded. MAJ Orther opined there was insufficient evidence to prove or disprove the ällenflarceny of private funds and larceny of private property pertaining to SSG Investigation established probable cause to believe SSG committed the offenses of larceny of private funds and property as interviews with the capturing unit personnel confirm there was approximately $72,900 U.S. Currency and 32 Million Iraqi Dinar alonwith other personal property which was from the home of the . confiscated . family. SSG was identified as the person responsible for ocuinenting the money and ensuring it was transferred with the detainees to the BCCF; however, interviews of the personnel responsible for receiving the property at the prison determined SSG only turned in a gold watch belonging to one of the family members; he never turn in the money. On 20 Jan 06, this office received a request from the 10 th Military Police Battalion (CID), to conduct, further investigative activity. Further, investigation disclosed there was no documen regarding tik apprehension or transfer of property belonging to the family. Interviews of capturing unit members revealed a large sum of currency was collected during the operation; however; there were no records or log book indicating it was turned in to BCCF. An interview of the property room custodian at the Ruthwania P • closed the currency collected during the operation was transferred to SSG for transport to BCCF. Extensive efforts were made to locate any records from the ia Palace, BCCF, and the Theatre Internment Facility (TIF), pertaining to the ily and their property, but all attempts were unsuccessful. Interviews of BCCF, TIF, and Ruthwania Palace personnel disclosed due to poor record keeping at the onset of Operation Iraqi Freedom, many records from that time period were lost, inadvertently destroyed or never existed. Investigation disclosed based on the e investigation, there was insufficient evidence to prove or disprove SSG committed the offense of Larceny of Private Funds and Property due to the lack of documentationand accountability of the property after the operation and capture of the family.. Further, there was no documentation or evidence to support the money of the family was ever turned in to the BCCF as no records existed to suppoffThe money was ever turned in. Case file to SAC for review and further guidance. STATUS/REVIEW OF CASE FILE TO DATE: 1. Interview of SKIM was completed. She related she did not know where the EPCD in reference to the money or the money itself was located. See also provided names of individuals whom she worked with in the detainee property section at BCCF, whom where supposedly still at BCCF. 2. The individuals SPC identified were all interviewed by the CID office at BCCF, and all individuals stated they did not know where the EPCD in reference to the money or the money itself was located, as it was not located in the detainee property section, BCCF. 3. All interviews conducted of SF ersonnel who had contact with the detainees deny any abuse. SGT was the lead SF interrogator at Ruthwania Palace, but he invoiced. Also, per the SF individuals interviewed SGT was the last person who had contact with the money taken from the families residence during the raid, and SGT reportably turned the money over to BCCF when he transferred the detainee o BCCF. But per personnel in the Detainee Property Section at BCCF, there is no record of the money there.

Gentlemen, I'm Special Agent with CID, Camp Victory, Iraq. I'm currently working an investigatiOn in reference to some missing/stolen money which was seized during a raid in which about eleven detainees, from the same family were apprehended, in the same house. A SF soldier reportedly turned the large amount of money (over $72,000.00. and over 32 million Dinar) over when he transferred the detainees from his units temp holding area tc Abu for detention, around late Dec 03. There are no records of the money ever being at Abu, and I can not talk tc the soldier who allegedly turned the money over, as he invoked his rights. If you would please I need some help with identifying the soldiers who worked in the Detainee Property SectiOn and the Detainee In-processing Section at Abu, around Dec 03. They are not in any trouble, I just need to talk to the soldiers who worked in these section to see if they remember the soldier ever turning in any money or remember the money ever being turned in. Also need to talk to them in reference to what the procedures were if detainees arrived at Abu with a large 'amount of currency. A SF soldier reportedly turned the large amount of money (over $72,000.00. and over 32 million Dinar) over when he transferred the detainees from his units temp holding area to Abu for detention, around late Dec 03. There are no records of the money ever being at Abu, and I can not talk to the soldier who allegedly turner the money over, as he invoked his rights. If you would please I need some help with identifying the soldiers who worke in the Detainee Property Section and the Detainee In-processing Section at Abu, around Dec 03. They are not in any trouble, I just need to talk to the soldiers who worked in these sections to see if they remember the soldier ever turning ii any money or remember the money ever being turned in Also need to talk to them in reference to what the procedures were if detainees arrived at Abu with a large amount of currency. I spoke with SGT IMP and she said there was not an evidence ledger. They do not run an "evidence romm" ii is a "property room." It is not organized, most of what they have is put into MRE boxes, ziplock bags, etc. As for documentation, they have a spreadsheet in a computer that they can search but it provides very little info other than what each detainee has for property.

How goes it sir, been a while. I beleive the last time I saw you was at Leonardwood while you were attending the SAC course and I was there for BNCOC. So how have you been I just got deployed here from the ft McCoy office a few weeks ago. If you do not remeber me, I worked with you at Benning for about a year before you were the A-QPS there, Well, any way here is an RFA for your office. I initially sent it to Fort Meade, as the soldier's unit is located in C and MD (thier AOR)„ but the soldiers lives in Ridgely, 1AIV (which is in your AOR),and Mr SAC at Meade, replied it was not his AOR (Ridgley is only about 10 miles south of Cumberland, go figure). MIN True she lives in Ridgley, WV, which is only about ten miles south of Cumberland, MD. The only reason I know this is because I was born in cumIDerland and most of my family lives in cumberland. They were captured about another case you might have been involved in It is involving the 24 Dec 2003, kept on BIAP for several days, then transferred to A u. Everyone working the first facility and on the raid states about $80,000.00 new and wrapped. There is no paperwork for any of the cash at all. On of the people who ran the facility stated he remembered "Feds" being interested in the cash but did not have any details. We have our eyes on the guy who transported the family and cash to Abu as he is the last in known possession with it. You previously gave a statement pertaining to the raid and possible abuse. All allegations of abuse have een unfounded but we are currently looking into the money which your guys recovered from the residence. 3rd SF apparently has no records of the facility and we have been unable to find any money trail. The soldiers who participated in the raid can mentally account for the money but it ends at the facility. At anytime did you see the money and who would/should have documentation of it? What should have been the procedure once the operators returned the property to the facility? Also where are you currently located, just in case we need to obtain another sworn statement? We have a good idea what happened but we need to try and get accountability for the funds up to that person. Thank you for your help.
