Court Case Brings Peace? Heard in the Mikveh: Before the court case everyone was fighting. Now they are all of a sudden talking about making peace and coming up with ways to go to Beis Din. Wednesday May 17th, Judge, Francois A. Rivera, signed the Court Order To Show Cause against Rubashkin and Election Services Corporation, including an immediate Stay Order as follows: "ORDERED that pending the hearing of this order to show cause the defendants are enjoined from permitting the installation of alleged winners of the unauthorized election, Rabbi Yitzchok Raitport, Rabbi Shlomo Segal, and Rabbi Yitzchok Zirkind to the Beth Din" posted by DaasHakohol @ Thursday, May 18, 2006

We Have Confirmed Reports that Both, Zirkind and Raitport did NOT attend the Hachtorah Party, in 770

UPDATED again at 12:30am Our reporters at the scene of Rubashkin's Fake Hachtorah Party Report that Neither Raitport nor Zirkind participated in the false "CROWNING" of the illegitimately elected individuals ! ! !

Who came to the Party? DaasHakohol reporters who were present, reported that their were only about 60 people present in "770" at this party and of the 60 people, the majority were Bochrim. In short, it was Big Bizyonos for them, and it seems to be beginning to "Sink In" into their heads that the vast majority of the community does not respect them at all, whatsoever. Earlier report from 10:30pm DaasHakohol.com has brought you the news yesterday, that it was rumored that Zirkind had issues and was expected to boycott the Hachtorah party, upstairs in the small shull in 770. Daashakohol reporters have now spotted Zirkind at a location, far from 770. As of 10:30pm, he did not attend the Hachtorah. Monday Night Lag B'Omer - Illegitimately Elected Candidates Served with Hazmonos (Rabbinical Subpoena) by Beis Din

Earlier in the day, Erev Lag B'Omer, A Hazmana (Rabbinical Subpoena) has been issued calling the above 3, illegitimately elected candidates, to a Din Torah. The Hazomono's against them were issued only after an exhaustive effort was made, by many elder Chassidim, to arrange for a peaceful settlement (see our previous post for complete details). Had they accepted the settlement it would have resulted in a lasting peace in the Badaz. Instead they chose to reject peace and they now face very serious charges in the Beis Din. Late this evening, Lag B'Omer, about Maariv time, they were actually Served with the Hazmonas, which now Halachicaly requires them to appear to Beis Din for a Din Torah. Should they fail to appear, they will likely be Sanctioned by the Beis Din who will issue a Siruv Against them. Should they fail to cooperate with the Subpoena (Hazmona) to a Din Torah, in addition to the "Siruv" (comparable to a Order of Contempt of Court) the Beis Din also has the right to issue a "Cherem" against them (Excommunication) as they have done with Fisher, when he refused to appear for a Din Torah. posted by Fair Elections @ Monday, May 15, 2006

"Elected" Candidates, Turn Down Final Call for Peace, by Zikney Hachassidim Click to Download Complete Letter in English and Hebrew - PDF A large group of Zikney Hachassidim wrote a beautiful letter calling on the "elected candidates" to unite in an effort for true peace in the Badatz. In their letter they explain that the Rebbe supported Elections which are Fair and Impartial because only then can the community be united since no one can challenge the legitimacy of a Fair Election. The last "election" held on Apr 30th was so ridiculously unfair that even Children are laughing at it and it will never be recognized by the vast majority of the community and the fire of the Machlokes will continue to divide the community forever Chas V'Sholom. There were several meetings scheduled with Zirkind in the last few days, including several meetings scheduled, Yesterday, Sunday and each time they were to have a meeting, Zirkind said "he was too busy" and kept on pushing it off. Late Sunday Night after countless tries it was apparent that they are not at all interested in peace and only "Other Means" will have to be used, to deal with them, for justice to prevail as the Rebbe wanted it in C.H. Although Zirkind refused all calls for peace, he is by no means a "Happy Camper" with Rubashkin's corruption team, either. As of Erev Lag B'Omer, it was rumored that Zirkind will Boycott the so called "Hachtorah" i.e. "Crowning" of the illegitimately elected individuals, on Monday Night in 770. NEWS SCOOP - Rabbi Osdoba's Reason for not keeping his Signed Binding Agreemnet regrding Cancelations of Apr 30th Elections DaasHakohol.com, EXCLUSIVE SCOOP U P D A T E D (Monday, 5/15/06,) Check out the comments section (at the end of this article) for partial excerpts from a written a comment sent to DaasHakohol.com, by Yitzchok Wagshul In an interview with Rabbi Osdoba to be published in the Crown Heights Chronicle, later this week, Yitzchok Wagshul intervied Rabbi Osdoba, as to why he did not keep his signed and binding agreement with his fellow Mara Deasra, Harav Schwei Shelita. -------------------------------Rabbi Osdoba's reply: According to Yitzchok Wagshul, Rabbi Osdoba said: "He was surprised that anyone should consider it strange that he changed his mind and ultimately favored not delaying the election, since that had been his position from the start." According to Wagshul Rabbi Osdoba explained that: "He had only signed the second document (agreeing to postpone the election) because the candidates themselves had called him and pleaded with him to do so, on the ground that they were being harassed over the controversy, and he felt that he could not ask them to accept such hardship. However, Rabbi Osdoba continued, later in the morning Mr. Rubashkin had brought the candidates themselves to him, and they had personally expressed their readiness to proceed. Under those circumstances, concluded the Rov, he saw no reason not to reaffirm his position all along, which was that the election should proceed." -------------------------------DaasHakohol.com, staff expressed surprise at Wagshul's report because it is inconsistent with Rabbi Osdoba's own words in his own handwriting (See Photos below) where he uses the words (in Hebrew and in the Translated letter in English) that the reason he "changed his mind" was because: "Whereas there was a misunderstanding with regard to the structure of the elections"

Eliyahu Poltorak, affirmed under penalty of perjury, that "at no point was the structure of the elections ever mentioned", when he negotiated with the Candidates nor was it ever mentioned by Rabbi Osdoba. Wagshul's explanations, only ads further confusion and doubt as to what in fact really happened. Who called the Shots? Who did the "Arm Twisting" to make people change their minds and violate their Signed, Halachicaly and Legally, Binding Contract Agreement, to Cancel the Elections. Poltorak response to Wagshul was that Wagshul's report, simply is inconsistent with all of his first hand information and that of many witnesses who can testify that: 1) "The structure of the elections" was never an issue with anyone. 2) Segal, never changed his mind, even after Rabbi Osdoba canceled his agreement. Segal told Eliyahu Poltorak that he should not waste his time negotiating with the Rabbonim, any more, but to negotiate with Boimelgreen instead. When Poltorak expressed Shock, asking Segal: "Who makes the decisions over here, the Rabbonim or the Money Men?", Segal, who was visibly upset at Rabbi Osdoba's reversal, responded, you "go an see for yourself". 3) Long after Rabbi Osdoba changed his mind, later in the day, that same Sunday, Zirkind, actually thanked Poltorak for his effort and at no point (before or after Rabbi Osdoba's cancellation of his agreement), did Zirkind ever mention any issue regarding any "Structure of the Elections" nor did Zirkind ever mention to anyone, that he ever changed his mind regrading his original, agreed upon cancellation, of elections. The above testimony from Eliyahu Poltorak and countless witnesses, is indicative that their never were, any such candidates, who ever "changed their minds" and lends credibility, to the many eye witness reports, who say that it was in fact Boimlgreen's "Arm Twisting" which caused the cancelations of the contract agreement to cancel the elections. Even Wagshul, in his paper to be released later this week, failed to provide any reports from any of the Candidates who could have said On Record, that it was their own "Mind Changing" which in turn, cased Rabbi Osdoba, to reverse his pror position.
