Open call for the execution of the work called for in the Specific Agreement N° CEN/534-535/2015-14 ‘Water and Space Heater Ecodesign’ Purpose:

Under the above-mentioned Specific Agreement (N° CEN/534-535/2015-04) funding has been made available for assessing (with Round Robin tests) the inter-laboratory reproducibility, repeatability and variability required by, and for parameters to be used for, the application of labelling delegated regulations and ecodesign regulations of space and water heaters, by evaluation of the standards implementing those regulations. The present call is therefore addressed to accredited laboratories (according to ISO/IEC 17025:2005 ‘General requirements for the competence of testing and calibration laboratories’, with the exception of new technologies for which accreditation is not existing yet , see Annex V) with a proven track record in testing all appliances under M/534 (water heaters) and M/535 (Space heaters) on all relevant parameters under these mandates. Interested laboratories are expected to form a consortium for this project and send in 1 single tender/offer on behalf of this consortium.

Introduction

The aim of this call is the execution of supporting co-normative work to support the implementation of the requirements regarding the verification of the declared parameters for the application of labelling delegated regulations and ecodesign regulations of space and water heaters (EU) No 811/12/13/14 2013 (see full references in Annex II) under the Standardization Requests M/534 (Water heaters) and M/535 (Space heaters), for which a Specific Agreement N° CEN/534-535/2015-14 ‘Water and Space Heater Ecodesign’ was signed between the European Commission and EFTA and CEN. 2)

Scope of the project

The scope of the project is for the technologies covered under the mandates M/534 (water heaters) and M/535 (space heaters), for the parameters regulated under these mandates, to provide a verification of the declared parameters for the application of labelling delegated regulations and ecodesign regulations of space and water heaters - (EU) No 811/12/13/14 2013. (See Annex II Short summary of objectives M/534 and M/535) The standardization requests M/534 and M/535 were accepted by CEN and (candidate) harmonized standards were developed by the technical bodies involved (see list in Annex III) The required verification of the declared parameters for the application of labelling delegated regulations and ecodesign regulations of space and water heaters - (EU) No 811/12/13/14 2013 has not yet been addressed in these (candidate) harmonized standards (quote M/534 – Clause 4.1.5 & M/535 – Clause 4.1.4): ‘Each harmonised standard shall include a verification procedure that can be used to verify the declared parameters in particular for market surveillance purposes.’ Such procedure shall:  



identify the sources of variability to be considered for market surveillance purposes; provide values for measurement uncertainties for the purposes of the verification procedure for the measured parameters taking into account the different sources of variability to be considered when a specific product is taken from the market and measured for market surveillance purposes; indicate if, in order to reduce the impact of variability to the system, specific criteria should be met by laboratories involved in the verification of the declared data (e.g. quality management system, qualification system, personnel training);’

Description of the different tasks / milestones

3.1)

Objective of the project

The general objective of the project under this call is: 

to provide for each parameter measured for the application of (EU) No 811/12/13/14 2013 and each appliance a value of the inter-laboratory reproducibility obtained with the test procedures of the corresponding standard developed; to propose improvements of the procedures from the standards; to evaluate the value of inter-laboratory reproducibility with the improved procedures; to propose for all parameters and appliances tested a value of a reasonable tolerance that shall be used for the market surveillance. Expected deliverables and deadlines

The detailed work program proposed shall meet the objectives for the Work Packages 1 to 8 as given under 6.2 of Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex” Scope – work program per Work Package. The Consortium co-ordinator shall provide the Final report for phase 1 to the Steering Group1 by 2019-06-23 at the latest to become part of the Final report2 for phase 1 3 . The work program shall be executed timely to meet this deadline. The project under this call shall provide the following deliverables:  Interim (progress) report (S+12 months) - 2018-09-30, including:

Steering Group for the project-> see under 7.0.4 of Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex” 2 The Steering Group will need to approve the final report for phase 1 by 2019-06-23 at the latest and full report to the EC has to be filed by 2019-06-30 (the approved final of phase 1 is part of this) 3 The work specific agreement N° CEN/534-535/2015-14 “Water and Space Heater Ecodesign” is split in 2 phases. Only phase 1 is subject to this call for tender. Phase 1) SUBJECT OF THIS CALL Co-normative part where in general term the laboratory/round robin tests (INTER-COMPARISON between laboratories) are performed and improvements to testing procedures will be identified. Phase 2) NOT PART OF THIS CALL: Implementation phase. The results obtained in phase 1 will be introduced/consolidated in revisions/amendments of the relevant product standards under M/534 and M/535.

 

Interim reports of the individual WP's and status report for approval approved by the Steering Group; Evaluation of activities done and identification of possible (planning) issues ahead.

 Final report for phase 1 (S+20,5 months) - 2019-06-16, including:  Final reports of the individual WP's and status report ready for approval by the Steering Group;  Final reports for WP 1 to WP 8, and final report for phase 1 ready for approval by the Steering Group, including recommendation for product standards to be updated for TC's not directly involved in this project;  Detailed work package regarding the revision/amendments of standards. In more detail the final report for phase 1 (S+20,5 months) shall contain following elements: A. An assessment (with Round Robin Tests) of the inter-laboratory reproducibility, repeatability and variability required by and for parameters to be used for the application of labelling delegated regulations and ecodesign regulations of space and water heaters - (EU) No 811/12/13/14 2013 - by evaluating the standards implementing those regulations; B. Comments to the relevant TC’s upon the practical application of the relevant standards in view of the above application (see Annex III Standards to be revised under Specific Agreement N° CEN/534-535/2015-14 “Water and Space Heater Ecodesign”) and suggestions of improvements of the procedures that are expected to lead to better reproducibility when needed. The final report for phase 1 (see under 3.3) will be the guidance for taking up the improvements into the standard Steering Group; C. Comments on tolerances to be used for the market surveillance in the light of the results obtained, a presentation of the state of the art and suggestions. Execution of the different tasks - Structure and Resource Requirements

3.4.1) Introduction 3.4.1.1) Interaction of the Consortium (Project team that wins the tender) with other entities An overview of the interaction of the Consortium with other entities can be found in: Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex” 7.0.1 Overal organisation in relation to Steering Group and CEN/TC’s;

3.4.1.2) Connection to deliverables, reporting and milestones The expected deliverables, reporting and milestones can be found under 3.2 and 3.3. Although it is the task of the Consortium to execute the tasks assigned timely and as efficient as possible, some requirements and some general project outlines are provided in the following clauses 3.4.2 to 3.4.3 to serve as a basis for the Consortium tender/offer. 3.4.2) Requirements for involvement of Technical Bodies A) New procedures that are proposed in the frame of the work shall be realistic and the cost of the testing shall not impact the testing cost in an unacceptable way. Therefore a dialog shall be established with the various TCs during the whole duration of the project in order to make sure that TC members are agreeing with the work done and proposal made. Requirements for the organization of the project under this call related to involvement of Technical Bodies are provided in the Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex” Under clauses: 7.0.2.1 Consortium management team 7.0.3 Coordination between Work Packages and Technical Committees 7.0.4 Coordination by Steering Group 3.4.3) Requirements for organisator/co-ordinator of the work within the Consortium This project shall be coordinated by an experienced Consortium co-ordinator, who is overall responsible for execution of the work under this call. Coordination of the project and providing reports and financial statements to NEN are among the responsibilities of this consortium coordinator. The co-ordinator will be in charge of most of communication from the consortium to NEN and vice versa. Requirements for the organization of the project under this call related to organisation of the work within the Consortium are provided in Annex IV ‘2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex’ Under clauses:

Costs to be included in the tender/offer of the Consortium

All costs necessary for the execution of the project as described under Clause 2, and 3.1 to 3.4 shall be included in the tender/offer of the Consortium. Further costs that are explicitly to be taken into account in the tender/offer and requirements on how these costs shall be stated in the tender/offer can be found under clause 7.6 of Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex”

Requirements for Consortium (tenderer)

The respondent shall comply to the following requirements: (1) The Consortium shall have the capacity to execute the task in a timely manner, according to the timetable (see under 3.2. and 3.3) for market conform rates; (2) The Consortium shall be qualified to execute the tasks assigned. Laboratories under the Consortium shall have experience with the test and tasks they are involved in including when possible experience with participation in similar work: testing, intercomparisons. For the Consortium co-ordinator experience and ability in coordinating international projects is required. (3) There shall be relevance of the project to the consortium daily activities; involvement in the testing, certification and standardisation of the products covered (4) The Consortium shall use independent laboratories for the testing program. This means that only laboratories accredited against ISO 17025 are eligible (exception for new technologies see Annex V); (5) The Consortium shall proof due diligence. Members of the consortium shall provide proof of their due diligence: Company information, registration, balance sheets, CV of main personal involved. Etc. (6) The Consortium shall demonstrate the quality of the project: The details given for execution of the project shall be given in the application of the tenderers - showing how the tenders will execute the work in practice. (7) The Consortium shall demonstrate adequate organisation: the way the project is organised including internal and external communication during the project. Etc. shall be given in the application of the tenderers - showing how the tenders will organize the work in practice (within WPs, between WPs, with NEN and stakeholders. Etc.)

(8) Be able to accept - the NEN General Purchase conditions(*) (See Annex VI) - the NEN General terms and conditions for the provision of technical services to NEN under Specific Agreements/Grant Agreements (*) (See Annex VII) - the Assignment of exploitation rights (See Annexes VIII). (*)Please note that for the part ‘Invoicing and payment’ the contract will state “All payments are subject to NEN having received from the EC and EFTA the funds related to the EC/EFTA contracts”

To comply with the first requirements (1), (2) and (3):In order to evaluate the capacity of the respondent to fulfill this requirement, for all the work packages detailed above the respondent shall indicate:   



The manpower necessary for completion of the work package task or subtasks. Information about the participants (laboratories) acting in the work package task or subtask demonstrating its ability to affect such manpower in the time frame required. Experience of the participants (laboratories) demonstrating that it has the ability to conduct such task or sub task. The WP project team leaders and Consortium co-ordinator shall provide evidence of experience in successful projects and the Consortium co ordinator shall provide evidence of experience in coordinating successful international projects. The main employees of the laboratories shall provide evidence of being highly experienced in testing of the relevant appliances. References of earlier projects/relevant experience related to the tasks to be performed and participation in Round Robin tests with labs in different European Countries, including the daily rates used for these projects.

To comply with the requirements (4) and (5): All the laboratories participating in the response shall be identified and their full accreditation against ISO 17025 shall be part of the response (exception for new technologies see Annex V). Proof of due diligence for all participating laboratories shall be provided. To comply with the requirements (6) and (7): The project proposal shall demonstrate this. This implies that the respondent must demonstrate a good understanding of the main issues related to testing and measurement uncertainties under M/534 and M/535.

How to answer to this call

To allow for possible communication between CEN and the potential respondents, the potential respondents shall inform Mr. Edward Zomers of their interest in this call and give a name and email

address for further contact. Any clarification about this call for tender shall be addressed to Mr. Edward Zomers. The question(s) and answer(s) will be forwarded to the email address given for contact to all potential respondents, regardless of who asked for clarification. The answer to this call shall be made by e-mail to the attention of Mr. Edward Zomers, secretary of CEN/TC 109 at the following address [email protected] at the latest by 2017-08-30. The answer shall be prepared by one representative of the respondent identified as Consortium co-ordinator. This representative will be responsible for all communication with Mr. Edward Zomers (reply to this call and all following communication). Next to the reply form for Consortium (See Annex I), the answer to this call shall be prepared in three parts:   

One technical part, One qualifications part, One financial part.

Incomplete answers will not be considered. The technical part shall explain how the respondent will produce the deliverables identified under Clause 3). For each work package the answer shall give: 

The details regarding the execution of the project. The work package shall be divided in subtasks as necessary. Intermediate results shall be highlighted and the forecasted timetable identifying the link between the sub-tasks shall be given. The work program and description provided shall demonstrate the knowledge of the respondent of the issues to be covered during the project.



The participants active for completion of this work package shall be identified (all laboratories that will be involved in the Consortium). One participant (laboratory) shall be identified as responsible for each work package (the WP project team leader).



The manpower necessary to complete the work package shall be identified and related to the sub-task and/or deliverable if relevant.



The capacity shall be demonstrated to achieve the whole programme prior to 2019-05-31

The qualifications part shall give the details of all participants and demonstrate that they fulfill the

requirements expressed in this call. The Consortium shall use the form in Annex I or to provide the necessary details concerning the Consortium. The person responsible for the co-ordination of the offer/tender shall be stated here to identify the legally responsible entity for contracting (company he/she is working for). Under C of the form in Annex I a list shall be provided with per Work Package the participating laboratories, WP project team leaders and employees. Organized per Work Package, each participant (laboratory) shall list its credentials and highlight the previous experience that will demonstrate its ability to conduct the task(s) or sub-task(s) that he is responsible for in a timely manner. For the participating laboratories this shall include the official documentation relevant to its accreditation against ISO 17025:2005 for the duration of the project. It shall also include the relevant information demonstrating the requested experience of the Consortium, all laboratories and all main employees of laboratories involved, as well as the relevance of the project for the Consortium. The financial part shall give the budget necessary for the execution of the whole programme. This budget shall be detailed as follows. Each participant (Laboratory) shall detail its costs involved in the completion of each work package by identifying:  

  

The number of man-hours by staff category, daily labour rate and overhead rate. The travel cost identifying the number of travels and the number of persons travelling. The purpose of the travel shall be given i.e. Project teams meeting, Consortium management team meeting, Steering Group meeting, other travel (reason). The consumables costs identifying the main items (including appliances purchase, gases, transport of appliances between labs, calibration gases). Costs for organizing meetings (venue, catering, hosting of webmeetings) The overhead costs. To account for these costs the participant can select either the FC (Full Cost) or 7%FR (7% Flat Rate) Cost Model. FC - Full Cost Model (real overhead model): This model applies to organisations, which have an accounting system that allows the share of their direct and indirect costs relating to the project to be distinguished and which can identify their real overhead costs. 7%FR – 7% Flat Rate Cost Model: The 7%FR model applies to organisations, which 1) do not have an accurate accounting system that allows the share of their indir ect costs relating to the project to be distinguished, 2) organisations which would participate on FC basis but choose to charge the overheads on a flat rate basis (7% on all direct costs)

For each work package shall be put in one overview

for each individual laboratory and accumulated for all participants (laboratories):     

The total costs, indicating the name and country of each laboratory and an indication of the part of the work where the laboratory will be involved. The direct staff costs and number of person day. The travel costs. The purpose of the travel shall be given i.e. Project teams meeting, Consortium management team meeting, Steering Group meeting, other travel (reason). The consumables costs (including appliances purchase, gases, transport of appliances between labs, calibration gases). The overhead costs.

Any further ‘costs for overall management’ for the total consortium shall be stated (if relevant):  

 

All the cost shall be given in EURO (not in thousands of euro) and shall exclude Value Added Tax (VAT). Additionally daily rates, number of days, and overhead costs/rates used for reference projects cited shall be provided when possible. (Overhead FC (Full Cost) or 7%FR (7% Flat Rate) Cost Model.) By signing of the Reply form for Consortium (See Annex I) the consortium shall accept:   

IMPORTANT: 



Offers/tenders including laboratories not accredited against ISO 17025:2005 will not be considered, apart from appliances that are rather new on the market and for which there are no or very few accredited laboratories in the EU (see Annex V). In this case, the participation of a non-accredited laboratory is acceptable. Offers/tenders shall be based on the required number of laboratories per individual work package. This is specified in clause 7.0.2.2 of Annex IV “2015-14 Proposal on Ecodesign Rev 2017-04-14 (2) WPs Annex”

I.

OBJECTIVES of M/534 and M/535

Under M/534: 1.1. Requested standardisation activities: CEN and CENELEC are requested to develop harmonised standards, covering the requirements set out in both Regulations, for water heaters, hot water storage tanks and for packages of water heater and solar device (electrically driven or using liquefied or gaseous fuels) and as indicated in the requested work programme given in Appendix I. The requested harmonised standards shall incorporate relevant measurement and calculation methods fully aligned with Commission Regulation (EU) No 814/2013 and Commission Regulation (EU) No 812/2013. Under M/535: 1.1. Requested standardisation activities: CEN and CENELEC are requested to develop harmonised standards, covering the requirements set out in both Regulations, for space heaters, combination heaters, packages of space heater, temperature control and solar device and packages of combination heater, temperature control and solar device (electrically driven or using liquefied or gaseous fuels) and as indicated in the requested work programme given in Appendix I. For both M/534 and M/535: 1.2 Public interests and policy objectives "….. The procedures must take into account the generally recognised state of the art, in order to ensure comparable measurement and calculation procedures for the product designs in the scope of the Regulations and to facilitate market surveillance activities." Under M/534: 4.1.1. General requirements "The requested harmonised standards shall be based on reliable, accurate and reproducible procedures and methods, which take into account the generally recognised state of the art. As a priority, the requested harmonised standards shall be based on existing standards for water heaters), that lay down procedures and methods for measuring and calculating the energy consumption and associated characteristics, sound power levels and emissions of nitrogen oxides (based on kWh fuel input GCV), carbon monoxide, particulate matter and hydrocarbons of these products. The standards shall take consideration of standards

Only phase 1 is subject to this call for tender. Phase 1) SUBJECT OF THIS CALL Co-normative part where in general term the laboratory/round robin tests (INTER-COMPARISON between laboratories) are performed and improvements to testing procedures will be identified. 6. Description of the different tasks 6.1 Introduction The work is organized in two phases:

1) SUBJECT OF THIS CALL Phase 1 is an investigation phase based mainly on analysis of INTER-COMPARISON between laboratories. This work is to be subcontracted following this for tender. The phase 1 will be monitored by NEN (see further); 2) NOT PART OF THEIS CALL:

Phase 2 is an implementation phase consisting in the update of the standards taking the input of phase 1 into consideration. Phase 2 will be carried out by the relevant TC’s under the coordination of NEN.

Phase 1: In this proposal for co-normative work in support of the REQUESTED WORK PROGRAMME for Ecodesign: (Space heaters under M/535 and Water heaters under M/534, the introductions are provided for each of the 5 Work packages under 6.2 numbered WP 1 to WP 8). These 8 Work packages are meant to be executed in parallel over a period of 20,5 Months. Duration of the action/planning

One of the main activities of phase 1 are the laboratory inter-comparison(*) tests, of which the results shall be used for - Determining the actual reproducibility of laboratories - Analyzing the reason for possible differences - Communicate with the TCs and propose possible improvements for the testing part of the standards - Improve laboratories testing procedures and good laboratory practice - The above includes also the evaluation of measurement accuracy required by standards and testing tolerances to be used for the market surveillance and the communication with the relevant stakeholders on the findings of the work. WP 1 is specifically dedicated to measurements that are common to several technologies (emissions for l gas and fuel oil appliances, sound power level) and the results should be communicated to all relevant TCs in this project WP 2 is preparing the common testing protocols, the common uncertainty calculation, etc. for the WP3 to 8 which are specific to products (WP3: boilers and water heaters, WP4: mCHP, WP5: Gas heat pumps, WP6 Fuel oil boilers, WP7 Electrical heat pumps; WP8 Solar heaters. (*) Inter-comparison tests consists in testing the same appliance in different laboratories with the same testing method. In practice the test is organized by sending the same appliance from laboratory to laboratory. The appliance is eventually send back to the first laboratory after the test to verify that there has been no changes in the appliance actual performances. 6.2 Scope WP 1 Emissions - CEN/TC 238 (including sound power level) Proposal for work package with CEN/TC 238 The work proposed shall include the following points: 1.

Check laboratories inter-laboratory reproducibility for NOx emissions levels that are below and in the range of the allowed emissions of Ecodesign requirements (For boiler = below 56 mg/kWh on gross calorific value):

Evaluate the part of variation of NOx that is due to “external factors”, and that is independent of the sampling, measurement instruments or procedures, etc. (this may be the most important part of the difference between results of inter-comparisons).

Propose ways to reduce or correct from those external factors

4.

Evaluate in the same manner the CO (will most probably be included in the next revision of the Ecodesign directive), as it is already included in the mandates M/534 and M/535. There are no limit values in the present Regulations /1/ /2/ /3/ /4/;

5.

Propose improvements of the CEN Report CR 1404 and validate this through an adapted intercomparison;

6.

Elaborate and validate a CxHy (unburned hydrocarbons) test measurement protocol;

7.

Establish a survey of existing methods for particulates measurements for fuel oil appliances will be made.

Check laboratories inter-laboratory reproducibility for sound power level,

WP2 Uncertainty calculation method of the emissions, efficiency and all other parameters needed for the legislations /1 to 4/ and common protocols for the INTER-COMPARISON + uncertainties Work program The work proposed shall have to include the following points: 1. Establish common protocols and procedures for the INTER-COMPARISON of all appliances in the scope of the project. This includes: a. The preparation of the practical instructions for the sending and transportation of the appliances between laboratories;

b. The preparation of all instructions needed for laboratories for the execution of the test; c. The preparation of test sheets with all data measurements; d. The preparation of uncertainty sheets needed for the execution of the calculation; e. The protocol & procedure for sending data after the execution of the test; f. The preparation of a document that describes the way that reproducibility is calculated and how possible outliers are treated; g. The preparation of a standard report for the INTER-COMPARISON; h. Organisation of the WP project team meeting for discussing and agreeing on the measurement protocol. 2. Calculate the uncertainties & reproducibility for all the INTER-COMPARISON and comment on the method proposed. Results of all labs shall be used for the reproducibility calculation unless they are outliers. In order not to duplicate efforts, only few labs will be requested to perform the uncertainty calculation according the CEN/CENELEC guide4.

3. Establish with the experience gained from the test of different technologies having the same function (heating and/or hot water production) a first analysis of the equivalency of testing methods used in the various standards. The work shall enable to conclude on the equivalence of standards used for efficiency 4. The Ecodesign Coordination Group TF advises to evaluate the overall inter-laboratory reproducibility in view of commenting on the tolerances to be used for market surveillance. This evaluation shall be performed. 5. For some of the work packages where there is less experience with testing according to the standard the first test shall be used to adjust the test procedure.

WP3 Ecodesign testing of sanitary hot water work package with CEN/TC 109 Work package programme The work proposed shall include the following points: 1. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for measured values needed to calculate space heating efficiency ηs and for combination appliance the water heating efficiency ηwh. Therefore the measurement of standby heat loss and auxiliary electricity consumption, according to EN15502-1/A1:2015 are to be included.

Eco-Design Coordination Group Task Force 2 ‘Uncertainty and tolerance’ Internal Guide, version 1.4 2/27GUIDE TO ASSESS MEASUREMENT UNCERTAINTIES FOR PRODUCTS AND SERVICES UNDER THE ECODESIGN DIRECTIVE.

2. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for the gas and electricity consumption measured according to tapping profiles as well as the annual consumptions calculated according to: i. EN 13203-2:2015 (combination heaters and designated water heaters); ii. prEN 13203-4 (mCHP-appliances in combination with Work Package 4); iii. prEN 13203-6 (gas heat pump in combination with Work Package 5). 3. Analysis of the test results. 4. Cooperation with CEN/TC 109 WG1 and WG4 to propose possible improvements of the relevant standards.

WP4 Work package with CEN/CENELEC JWG FCGA (on mCHP) a) Work package programme 1. The work proposed shall include the following points: Organise an INTER-COMPARISON test between laboratories in order to estimate the inter-laboratory reproducibility for the measured values needed to calculate the seasonal efficiency (ηs) according to EN 50465:2015 (note that hot water production is covered by WP3); 2. Analysis of the test results; 3. Cooperation with CEN-CENELEC JWG FCGA to propose possible improvements of the standard. The work should also enable conclusions on the applicability of the prescribed test for the technology tested. This should be extrapolated to other mCHP technologies as far this is possible. WP5 Work package with CEN/TC 299 (on gas heat pump) Work program 1.

The work proposed shall include the following points:Organise an INTER-COMPARISON test between laboratories in order to estimate the inter-laboratory reproducibility for the value of the GUE (Gas Utilization Efficiency) or the SPER(Seasonal Primary Energy Ratio) and all the measured parameters needed to calculate seasonal efficiency (ηs) according to EN12309 series (note that hot water production is covered by WP3);

2. Analysis of the test results; 3. Cooperation with CEN/TC 299 to propose possible improvements of the standard. The work shall also enable conclusions to be made on the applicability of the prescribed test for the technology tested, and one shall conclude on the possible lessons that would also apply to other gas heat pump technologies as far this is possible.

WP6 Work package with CEN/TC 57 (fuel oil boilers) Work program The work proposed shall include the following points: 1. Synthesis of the known experience with Inter-comparisons of fuel oil boilers 2. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for the value of the heating and hot water efficiency and all the measured parameters needed to calculate seasonal efficiency (ηs) according to EN304 and EN 15034 3. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for the value of the emissions including CO, NOx and particles (suit) 4. Analysis of the test results; including information on the Nitrogen content of the fuel oil used for the testing 5. Cooperation with CEN/TC 57 to propose possible improvements of the standard.

WP7 Work package with CEN/TC 113 (electrical heat pumps) Work program The work proposed shall include the following points: 1. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for the value of the heating and hot water efficiency and all the measured parameters needed to calculate seasonal efficiency (ηs) according to EN 14511-2, EN 14825 and EN 16147

2. Organise an INTER-COMPARISON test between laboratories in order to estimate the inter-laboratory reproducibility for the value of the noise according to EN 12102. 3. Analysis of the test results 4. Use the results obtained to assess the standard EN 14825 to estimate the efficiency of the hybrid technologies (add on or integrated). Use the results from HP and gas boiler testing to evaluate the method described in EN 14825 and the determination of the seasonal efficiency and accuracy. 5. Cooperation with CEN/TC 113 to propose possible improvements of the standard.

WP8 Work package with CEN/TC 312 (solar heaters) Work program The work proposed shall include the following points: 1. Organise an INTER-COMPARISON test between laboratories in order to estimate the interlaboratory reproducibility for the value of the heating and hot water efficiency and all the measured parameters needed to calculate seasonal efficiency (ηs) according to EN12976 and EN12977 series. For this purpose, two complete standard solar water heater system consisting of collectors (EN 12975), a solar water heater store (EN 12977-3) and a solar combistore (EN 12977-4) shall be tested by different laboratories as individual components. The same water heater and collectors shall furthermore be tested as factory made system according to EN12976. 2. Analyses of results The test results of the individual components (collectors, stores) shall be compared directly as well as the calculated annual efficiencies of the water heater system if tested under EN12976 and if tested under EN12977. For a real statistical analysis the number of samples is too small. Therefore, the main result of this comparison of the results shall be to identify the main drivers of deviations (if there are) between the final results. Based on these insights dedicated recommendations and guidelines for better testing of solar devices could be elaborated. 3.

Cooperation with CEN/TC 312 to propose possible improvements of the standard. Any insights of these comparative tests would be included in the future revisions of the standards anyway.

There are two main issues to be addressed when the testing solar appliances: 1.) For some products there are different methods or even standards for testing the same product. It must be expected that there are deviations between the results of the different methods 2.) There may be some deviations between results from different test labs. In addition to te laboratories own uncertainties of measurement, the possible sources are: Reliability/reproducibility of the method itself and/or interpretation of the standards. The WP shall address these two issues by taking systems that can be tested according to different standards/methods. Then comparing the results and identifying the sources of the deviations, if there are. This has not been done before and therefore will provide for the first time a solid basis of test results for further discussions and input to standardisation, for better defining the methods itself, identifying sources for deviations and better defining which method to be used for what type of system. This will include also a desk- evaluation of indoor test method.

The work shall include the existing analyses and discussions about methods in collaboration with the relevant stakeholders. Measurements, other round robins that have been carried out in the frame of the Solar Keymark Scheme and any other previous studies on the comparability of test results will be considered, if available. Because of the cost of testing, the number of laboratories for this WP shall be restricted to 3 only. A special care should therefore be taken by choosing the laboratories in term of experience, quality of the technical equipment and about the skills of the staff.

The interim reports are scheduled for month 12 (mid phase 1 - report to the EC & the Steering Group) and at 20,5 months (end of phase 1 - report to EC ). The consortium leader shall make sure the adequate and well-structured input is provided to be agreed with NEN, connecting to the structure of the reports to the EC to NEN to create these reports (that are to be approved by the Steering Group and CCMC before they can be sent to the Commission). b) This report includes - Interim reports of the individual WP's and status report approved by Steering Group; - Final reports for WP 1 to WP 8, and final report for phase 1 approved by Steering Group, including recommendation for product standards to be updated for TC's not directly involved in this project; - Detailed work package regarding the revision/amendments of standards. c) This is the final report at the end of phase 2. 7.0.2 Organisation Consortium 7.0.2.1 Consortium management team: WPs shall be carried out by a WP project team (participating laboratories) and a WP Project team leader for the organisation of the work. The Consortium co-ordinator shall monitor finalization of (sub) deliverables and coordinate involvement of CEN/TC where requested. The consortium management team shall meet every 3 months and shall report to the Steering Group every 3 months in order to ensure the full visibility and smooth running of the project. 7.0.2.2 WP Project Teams: WP Project Teams shall be established to undertake each of the tasks of the work package. Depending on the type of technology* such teams will typically have 3-12 laboratories involved per work package. For each laboratory involved 1 WP project team member shall be assigned to the WP project team of that work package. One of the WP project team members will be tasked with the leadership of the team. (WP Project team leader). The WP Project teams are expected to meet with adequate frequency to adequately address the tasks assigned (see under 7.6.2)

Regular reporting to the consortium management team shall be established in order to ensure the full visibility and smooth running of the project. All laboratories participating in WP 1, WP 3, WP 4, WP 5, WP 6, WP 7 and WP 8 are also expected to provide a project member for WP 2. Iterative tests are meant to cover a specific issue to be investigated during the project course. Such test will have to be discussed with the consortium management team.

The overview above may be adapted for the project optimization and to better respond to the project need. 7.0.3 Coordination between Work Packages and Technical Committees: There is a need for information exchange between the TC's and the Work Packages on TC Working Group level. 1 liaison officer per TC – Convenor of the most involved WG – or alternatively TC chair or secretary. This is for the technical bodies themselves to decide. More detailed organization shall be established when the project starts. For example: -

A short call every 2 months or more when needed between the liaison & the WP leader; Access to part of the project Website with documents and news dedicated to CEN & TCs; An invitation to WP project team meeting where the detail of the WP is discussed; Ad hoc additional contacts when needed.

7.0.4 Coordination by Steering Group: Effective coordination between all parties engaged will be of utmost importance for the realization of the objectives of M/534 and M/535. A Steering Group will be established. This group will have the overall responsibility of the coordination of the project. The Steering Group will be composed of all WP Project Team leaders, The Consortium Co-ordinator, representatives from Technical Bodies, NEN, etc. Documents distribution related to the Steering Group will be handled through CEN Livelink (WG or AHG under CEN/TC 109 – Access to Livelink will be given to Steering Group members. Also for people external to standardiation system - e.g. WP Project Team members). There will be 4 Steering Group Meetings organized during the project under this call. Attendance of the Consortium management team (the Consortium co-ordinator plus the project team leaders of all the WP’s) is required (See 7.6.2).

7.6 Cost elements to be included in the offer/tender 7.6.0 General IMPORTANT REMARK The subcontracting of all laboratories participating in the Consortium is dealt with through 1 contract with the project consortium through NEN. 7.6.1 Mandays Consortium Description of tasks for which man-days shall be included in the Consortium offer: -

Annex V Exceptions for accreditation under ISO 17025:2005

For this project the Consortium (tenderer) shall use independent laboratories for the testing program. This means that only laboratories accredited against ISO 17025 are eligible. There is an exception allowed where it concerns testing of appliances that are rather new on the market and for which there are no or very few accredited laboratories in the EU. In this case the participation of a non-accredited laboratory is acceptable. When a laboratory not accredited for a given appliance test is included in the project proposal, the tenderers must justify the reasons and detail the qualifications of the given laboratory for the given appliance testing. NEN may require the removal form the project of partner(s) that fails to demonstrate their ability to test a given appliance.

Annex VI NEN General Purchase Conditions for Services

Definitions 1.1 Services: all work, activities and/or acts to be performed by the Contractor for NEN on the basis of the Contract; 1.2 Aids: all items that NEN makes available to the Contractor to facilitate provision of the Services, including –but not limited to –models, pictures, films, drawings, photos, stamps and other image, sound and information carriers; 1.3 IP Rights: all intellectual property rights, including –but not limited to –copyrights, trademark rights and database rights; 1.4 Purchase Order: the order for the provision of Services that NEN places with the Contractor; 1.5 Purchase Conditions: these general conditions of NEN that apply to and form part of the Contract; 1.6 Purchase Price: the payment owed by NEN to the Contractor for the Services by virtue of the Contract; 1.7 NEN: client, Stichting Koninklijk Nederlands Normalisatie-Instituut (the Netherlands Standardisation Institute), having its registered office and principal place of business at Vlinderweg 6, 2623 AX Delft, the Netherlands; 1.8 Contractor: the (potential) other party of NEN; 1.9 Contract: any contract for the provision of Services that is entered into between NEN and the Contractor, including any amendments or additions thereto. The Contract will consist of these Purchase Conditions at the very least; 1.10 Party: NEN or the Contractor, depending on the context; 1.11 Personnel: the members of staff or auxiliary staff to be brought in by the Contractor in performance of the Contract. Applicability 2.1 These Purchase Conditions will apply to and form an inextricable part of all Contracts, quotes and offers issued by the Contractor and will apply to all order confirmations by the Parties; 2.2 The applicability of the (general) conditions of sale or other conditions used by the Contractor is expressly excluded, except where explicitly agreed otherwise. Contract formation 3.1 A Contract will only be formed further to the written acceptance by NEN of an offer or quote issued by the Contractor, or when a Contract is signed by both Parties; 3.2 The Contractor will not be able to derive any right whatsoever to a subsequent order from the Contract; 3.3 If there are any discrepancies between the Purchase Order and an offer or quote, the content of the Purchase Order will serve as the content of the Contract; 3.4 If there is any inconsistency between the Dutch text of the Purchase Conditions and translations thereof, the Dutch text will always prevail.

Amendments to the Contract 4.1 Amendments or additions to the Contract will be binding only insofar as the Parties, represented by people who are authorised for that purpose, have expressly agreed thereto in writing; 4.2 The Contractor will be obliged to render its cooperation in any amendments to the Contract, including amendments to the extent or nature of the Services. NEN will observe the requirements of reasonableness and fairness when exercising this right; 4.3 The Contractor will immediately provide NEN with a written, reasoned notification of the consequences of the amendment envisaged in terms of price, quality, functionality, additional costs, delivery times and guarantees for the Services to be provided by the Contractor; 4.4 If an amendment would cause the Purchase Price to increase, NEN will be required to grant its written approval of the said increase, in the absence of which the Contractor will not be able to charge the increased Purchase Price; 4.5 If NEN feels that the consequences of an amendment envisaged by Contractor are unreasonable, NEN will be entitled to terminate the Contract.

Guarantees provided by the Contractor 5.1 The Contractor will guarantee that the Services comply with the requirements set out in the Contract and with the standards and other agreements customary in the trade, industry or services in question; 5.2 The Contractor will guarantee that the Services will be carried out in a professional manner by competent Personnel, with due observance of all relevant requirements imposed by legislation and/or other government regulations issued in this respect and also that the Services will at least be of the quality that may be expected of a good, expert professional, acting with all due care, in similar conditions and pursuing his/her occupation in the manner customary; 5.3 The Contractor will guarantee that the Services are suitable for the purpose specified to the Contractor and that the results of the Services will comply with the reasonable expectations of NEN in terms of characteristics, quality and reliability; 5.4 In satisfaction of its guarantee obligations, the Contractor will be obliged, for a period of one year after the provision of the Services in question, to remedy all failures resulting from inadequate Services free of charge and within a reasonable period of time after such failures have been detected. The aforementioned remedy will not affect any other rights or claims that NEN has by virtue of the Contract and by law. Place, duration and time of Services 6 The Service will be provided at the time(s) and place(s) specified in the Contract, in the absence of which the Contractor will be in default without any notice of default being required for this purpose. Personnel and third parties 7.1 The Contractor will not be entitled to replace individuals who are responsible for performance of the Services without the prior written permission of NEN. NEN will not withhold its permission on unreasonable grounds. NEN may attach further conditions to its permission; 7.2 If NEN requires the replacement of individuals who are responsible for performance of the Services, because NEN believes that this is in the interest of the performance of the Contract, the

Contractor will comply without changing the Purchase Price, except where this is contrary to the principles of reasonableness and fairness; 7.3 If the individuals who are responsible for performance of the Services are to be replaced, the Contractor will make individuals available who have a level of education, training, experience and expertise that is at least equivalent to the persons to be replaced. The rates applicable for the original individuals will not be increased if they are replaced; 7.4 When performing the Contract, the Contractor will be permitted to outsource all or some of the obligations arising for it under the Contract to third parties at its own risk and expense, but only if and after it has obtained the written permission of NEN to do so. NEN will be able to attach further conditions to its permission; 7.5 The permission granted in accordance with this article will not affect the responsibility and liability that the Contractor has in relation to performance of the obligations set out in the Contract and also its other statutory obligations, including obligations under tax and social insurance legislation.

Aids, goods and data 8.1 NEN may make Aids available to the Contractor on loan. Aids and goods that the Contractor produces or purchases for and/or on the instructions and/or at the expense of NEN will remain or become the property of NEN respectively; 8.2 The Contractor will maintain the Aids and goods in its possession in a good state of repair and insure them, where appropriate, against fire and theft, for the duration of the period in which they are under its supervision; 8.3 The Contractor will not be permitted to use the Aids and/or goods and/or data made available by NEN for any purpose other than that for which they were provided. Nor is the Contractor permitted to make the said Aids and goods and data provided by NEN available to third parties without the written permission of NEN; 8.4 The use of the Aids and/or goods and/or data provided by NEN will be entirely at the risk and expense of the Contractor; 8.5 The Contractor will make available to NEN, free of damage, any Aids, goods and all data (computer files, etc.) that it has in its possession in relation to its performance of the Contract within 10 (in words: ten) working days of the date on which the order is completed, or however much earlier as is reasonable. Failure to do so on time or the return of Aids that have been damaged will result in the imposition of an immediately due and payable penalty of € 500.00 (in words: fivehundred euros), without prejudice to the right that NEN has to demand payment of the actual losses sustained in addition to the penalty, including the losses to be sustained by NEN as a result of delays. NEN will be entitled to deduct the amount of this penalty from the Purchase Price.

Invoicing and payment 9.1 The Contractor will invoice NEN for the Services supplied on the basis of the Purchase Price agreed. The Contractor will send its invoices to NEN, stating the NEN Purchase Order Number (PO number) and, if applicable, also a copy of acceptance and other information required by NEN, including –but not limited to –time sheets and other proof of the costs incurred; 9.2 Unless expressly agreed otherwise in writing, invoicing and payment must be made in euros (€);

9.3 NEN will pay the Purchase Price for the result of the Services supplied within 30 (in words: thirty) days of the date on which the invoice in question is received. Payment of the invoice by NEN will not constitute its acknowledgement that the result of the Services supplied meets the guarantees provided in accordance with Article 5; 9.4 If NEN fails to pay on time or fails to pay an invoice on the grounds of a probable substantive inaccuracy in the said invoice, or if the Services invoiced are not sound, this will not give the Contractor the right to suspend or terminate its Supply and/or activities; 9.5 NEN will be entitled to offset the invoice amounts due against amounts due to NEN from the Contractor. Failure to perform 10.1 If the Services supplied are not in compliance with the guarantees referred to in Article 5, NEN will be able to require the Contractor to supply the Services with due observance of the aforementioned article. The Contractor will bear all costs involved in relation to the above; 10.2 If the Contractor fails to comply with a requirement as referred to in the previous paragraph, NEN having demanded it to do so in writing, within the period of time stipulated therein, or if a strict deadline has been exceeded, NEN will be entitled, without prior judicial intervention, to have the Services provided by a third party at the expense of the Contractor and will be entitled to terminate the Contract in accordance with the provisions of Article 14 and, consequently, credit the Purchase Price (or the part thereof) that has already been paid for the Services in question; 10.3 The provisions of Paragraphs 1 and 2 of this article will not affect other rights and claims that NEN is able to derive from a failure. Liability 11.1 The Contractor will be liable for all losses, including –but not limited to –those resulting from the rectification of services by third parties and any loss of profits, that might arise for NEN, its employees or its customers from or as a result of actions relating to the Contract, insofar as these losses can be regarded as a form of attributable failure or a wrongful act on the part of the Contractor, its Personnel or of other individuals whom the Contractor has involved in the performance of the Purchase Order. The aforementioned will include any losses that might ensue from the presence, use, supply or removal of property belonging to the Contractor, its Personnel or other individuals that the Contractor has involved in performance of the Purchase Order, and the losses arising from any delays; 11.2 The contractual and statutory liability ensuing for NEN from the Contract will be limited to a maximum of the value of the order on the basis of which the Services are supplied, excluding VAT. In case of a continuing performance contract, the contractual and statutory liability applicable to NEN will be limited to a maximum of the estimated average value of a contract year, excluding VAT. Liability will never exceed the amount insured by NEN; 11.3 The Contractor will indemnify NEN against any third-party liability to pay compensation as referred to in Paragraph 1 and also in relation to all losses that NEN sustains or will sustain in relation to this possible liability. If a third party lodges a claim against NEN in respect of the above, NEN will notify the Contractor of this situation immediately, also sending it all relevant information; 11.4 The Contractor will fulfil all obligations relating to Personnel, including those applicable under tax and social insurance legislation. The Contractor will indemnify NEN against any liability in this connection and also against all losses that it sustains or is to sustain in relation to these possible claims.

Force majeure 12.1 The Contractor will notify NEN of a temporary force majeure situation and the cause of a situation of this nature in writing and will do so as soon as the situation in question has arisen. In this situation, NEN will be entitled to choose between: a) granting the Contractor an additional and reasonable period of time in which to fulfil the obligations ensuing for it under the Contract, being a maximum of four weeks. If the Contractor is still unable to fulfil the obligations arising for it under the Contract once this period of time has expired, NEN will be entitled to terminate the Contract out of court with immediate effect, without being obliged to compensate the Contractor or reimburse it for any costs; or b) terminating the Contract out of court with immediate effect, without being obliged to compensate the Contractor or reimburse it for any costs; 12.2 The Contractor will notify NEN of a permanent force majeure situation on its part immediately, after which NEN will be entitled to terminate the Contract out of court with immediate effect, without being obliged to compensate the Contractor or reimburse it for any costs; 12.3 The term 'force majeure' will not include the following in any event: a shortage of Personnel, strikes, the illness or unsuitability of Personnel, personnel conflicts, a shortage of raw materials, transport problems, the late delivery or unsuitability of the goods required, the impossibility of obtaining a licence or permit, or a situation in which a licence or permit is not obtained on time, liquidity or solvency problems on the part of the Contractor, or the failure of third parties brought in by the Contractor.

Imminent delay 13.1 If there is an imminent risk of a delay in the progress of the Services to be provided, the Contractor will immediately notify NEN of this situation in writing and by telephone, stating the cause and consequences of the delay in question. The Contractor will also propose measures designed to avoid any further delay; 13.2 NEN will inform Contractor about its agreement or non-agreement to the measures proposed and the consequences indicated within a reasonable period of time of the receipt of the notification referred to in Paragraph 1. Agreement will not constitute the acknowledgement by NEN of the cause of the imminent delay and will not affect other rights or claims on the part of NEN under the Contract and by law. Insurance 14.1 The Contractor will have taken insurance commonly considered appropriate and customary and will maintain this insurance for the following risks: professional liability (risks that ensue from professional errors), business liability (including liability for damage caused to individuals or property belonging to NEN) and the loss of and damage to machinery and equipment (including losses and damage ensuing from fire and theft), including the property belonging to NEN; 14.2 When requested to do so by NEN, the Contractor will immediately submit (an authenticated copy of) the policies and proof of premium payment for the insurance referred to in Paragraph 1 or a declaration from the insurer relating to the existence of these insurance policies and payment of the premiums due. The Contractor will not cancel the contracts of insurance or the conditions under which they have been entered into without the prior written permission of NEN. The insurance premiums due from the Contractor will be deemed to have been included in the prices and rates agreed on.

IP rights General Purchase Conditions for Services 15.1 IP rights that can be exercised –wherever and whenever –in relation to the results of the Services will be vested in NEN. Under the Contract, these IP rights will be transferred to NEN by the Contractor at the time at which they arise, which transfer NEN herewith accepts; 15.2 If the Services are (also) provided with the use of existing IP rights to which NEN is not entitled, the Contractor will grant NEN a non-exclusive and non-terminable right of use for an indefinite period of time. In this situation, the Contractor will guarantee that it is entitled to grant the aforementioned right of use; 15.3 If the transfer of the rights referred to in Article 17(1) and Article 17(2) would, at any time, require a further instrument, the Contractor hereby irrevocably authorises NEN to draw up such an instrument and also sign it on behalf of the Contractor, all notwithstanding the Contractor's obligation to cooperate in the transfer of rights, immediately on NEN's request, without being able to attach conditions to that cooperation; 15.4 If a difference of opinion arises between the Parties about the intellectual property rights relating to the Services, as referred to in Article 17(1) and Article 17(2), it will be assumed that these rights are vested in NEN, except where the Contractor produces proof to the contrary. In all cases, NEN will continue to be entitled to use the outcome of the results as envisaged in the Contract; 15.5 The Contractor herewith waives to NEN any and all personality rights to which the Contractor is entitled, as referred to in the Copyright Act (Auteurswet), to the extent permitted by the regulations applicable. To this end, the Contractor, being authorised to do so, will, also on behalf of its Personnel and any third parties engaged by it, waive to NEN any and all personality rights to which the aforementioned Personnel and third parties are entitled, to the extent permitted by the regulations applicable; 15.6 The Contractor will indemnify NEN against claims from third parties relating to the (alleged) infringement of IP rights vested in the said third parties, including Personnel, including similar claims relating to knowledge, illegal competition and suchlike. The Contractor undertakes to put all measures in place at its expense that could contribute to the prevention of stagnation and to the limitation of the additional costs to be incurred and/or losses to be sustained as a result of the infringements in question; 15.7 Without prejudice to the provisions above, NEN will be able, if third parties hold NEN liable for the infringement of IP rights, to terminate all or part of the Contract in writing and out of court, without prejudice to the other rights it has vis-à-vis the Contractor, including –but not limited to –any right to compensation. NEN will only exercise its right to terminate the Contract after consulting the Contractor; 15.8 Should other IP rights arise in relation to the result of the Services provided, these may never be enforced against NEN and the Contractor will grant NEN a non-exclusive and non-terminable right of use in this respect for an indefinite period of time, which it will do for no consideration and in the interest of the objectives envisaged when entering into the Contract. Confidentiality 16.1 The Contractor will be obliged to put measures in place to ensure that all information made available by NEN remains confidential; 16.2 The Contractor will not, in any way whatsoever, disclose anything that comes to its knowledge during the performance of the Contract which it knows is, or could reasonably suspect to be, confidential, except where obliged to do so by law;

16.3 The Contractor will oblige its Personnel and all other individuals that it engages to perform the Contract to comply with the confidentiality obligation referred to in this article and will guarantee that the aforementioned individuals will comply with the said obligation; 16.4 If it violates the confidentiality obligation, the Contractor will forfeit an immediately due and payable penalty of € 1,000.00 (in words: one-thousand euros) without prejudice to the right that NEN has to demand payment of the actual losses sustained in addition to the penalty. Publications or advertisements 17 Without NEN’s consent, the Contractor may not implicitly or explicitly refer to the order (or the granting of the order) in publications (including press releases) or advertisements, or use NEN's name as a reference. Employees 18 Throughout the term of each Contract and for a period of one year thereafter, the Parties will not employ any of the other party’s employees who are involved in the performance of the said Contract, without the prior written permission of the other party. Assignment of rights and obligations under the Contract 19 The Parties may not transfer the rights and obligations ensuing from the Contract to a third party without written permission. Void and voided provisions 20 If one or more provisions of these Purchase Conditions or the Contract prove to be void or are declared void by the court, the remaining provisions of these Purchase Conditions and the Contract will retain their legal effect. The Parties must consult on the void or voided provisions in order to make a replacement arrangement. The replacement arrangement will not affect the purpose and essence of these Purchase Conditions or the Contract.

Continuing provisions 21 Provisions that are intended by their nature to continue after the end of the Contract will subsequently remain effective. These provisions include guarantees (Article 5), liability (Article 12), IP rights (Article 17), confidentiality (Article 18), employees (Article 20), applicable law and competent court (Article 24). Applicable law and competent court 22.1 Dutch law will apply to the Contract; 22.2 Any dispute between the Parties in relation to the Contract will be submitted exclusively to the court that is competent for that purpose in the judicial district of The Hague.

Annex VII B. General terms and conditions for the provision of technical services to NEN under Specific Agreements/Grant Agreements B.1 Applicability B.1.1 The terms and conditions contained in this Annex are applicable to any Contractor for AGREEMENT FOR THE PROVISION OF TECHNICAL SERVICES TO NEN, the Netherlands Standardization Institute, a foundation registered in the Netherlands. B.2 Notices B.2.1 Any notice required or permitted to be given under the present Agreement by one party hereto to the other shall be in writing and shall be deemed to have been given as of the second business day following the date of mailing if mailed to the party to whom notice is to be given, by registered or certified mail, postage prepaid and properly addressed. B.3 Amounts payable B.3.1 A maximum expense allowance (i.e. maximum budget) for this work is specified in Article A.3 of the Contract. This maximum expense allowance limit may apply in two different kinds of, not mutually exclusive, circumstance: The maximum expense allowance for the services covered by this Contract depends upon a budgetary envelope made available for this work. Therefore no extension whatsoever of the work undertaken, even if perfectly justified by the circumstances, can implicitly or automatically lead to an expense allowance increase. The maximum expense allowance for the services covered by this Contract depends on the progress or completion of the activity to the satisfaction of EC/EFTA and notification thereof to NEN. (EC/EFTA has the obligation to respond within 60 man-days, additional enquiries by EC/EFTA may result in suspensions to this timeframe, such suspensions will end when the required information has been provided by NEN). Provided NEN has received notification of satisfactory completion from EC/EFTA, correct and undisputed invoices for the services shall be paid by NEN to the Contractor within 15 workdays. In case (an) initially foreseen payment(s) from the EC/EFTA to NEN is (are) not executed due to the failure to deliver (entirely) the foreseen deliverable(s), the Contractor will no longer have the right to claim the related payment(s), even in those cases where the failure to deliver is caused by factors outside the will of the Contractor. B.3.2 The Contractor will be informed completely and as soon as possible about any disruption in the processes, possibly affecting the payments under this Contract and the corresponding tasks to be executed. B.4 Subcontracting, employing and hiring B.4.1 The Contractor is prohibited from subcontracting to third parties for the services provided under this Contract.

B.5 Termination B.5.1 The Contract may be terminated without compensation by either party to the Agreement upon three months' prior written notice to the other party. The Contractor shall be entitled to accrued and unpaid compensation due to Contractor as of the date of termination payable, corresponding only to the part of the Agreement fulfilled, after deduction of advance payments. B.5.2 The Contract may be immediately terminated, without prior notice: I. upon the death of the Consultant or if the Consultant shall be rendered incapable by illness or any other valid cause from complying with the terms or provisions of the Contract for a period of time NEN determines to be unreasonable; II. if the Contractor materially breaches any of the terms or provisions of the Contract; III. if the Contractor habitually neglects the duties as contemplated under the Contract; IV. if the Contractor is adjudged bankrupt or applies for judicial or extra-judicial bankruptcy or liquidation or dissolution or otherwise discontinues business or if a receiver, administrator, custodian, liquidator or the like is appointed to administer property or assets of the Contractor. In the event of termination under this provision, the termination shall be effective as of the date of notice of termination. B.5.3 In the event of failure by the Contractor, duly notified by registered letter from NEN, to fulfil the obligations of the Contractor under this Contract, the Contractor will be given three weeks to resolve the failure. If no solution takes place in these three weeks, the Contract may be terminated by registered letter without prior notice or payment of any compensation whatsoever by NEN, notwithstanding NEN’s possibility to recover all damages caused by Contractor. B.5.4 If the total of advance payments made before the date of termination exceeds the sum finally due, the Contractor shall repay the excess in full to NEN within 60 man-days upon receipt of a request for repayment. B.5.5 In the event the Contractor’s services are no longer provided to NEN, the Contractor agrees to deliver promptly to NEN all documents, memoranda, reports, files, samples, correspondence, lists, or other written or graphic (digital) records, and the like, relating to NEN’s business, which are or have been in possession of the Contractor or under control of the Contractor. Such materials shall be and remain NEN’s sole property, regardless of who actually prepared the original materials. A copy of the work done by the Contractor may be kept by the Contractor for educational or research purposes only. B.6 Liability B.6.1 The services shall be performed with skill, care and diligence in accordance with normal professional engineering and consulting standards and practices. B.6.2 Neither NEN nor the Contractor nor their Directors or Employees may under any circumstances or for any reasons whatsoever be held liable to each other or to each other’s personnel for damage sustained during the performance of the Contract. B.6.3 Neither NEN nor the Contractor is responsible to the other for insuring the other Party. B.6.4 NEN indemnifies the Contractor and the Consultant against all claims from third parties on account of damage or loss suffered by these third parties resulting from the application or use of the result of their work by CEN or by another person to whom NEN or CEN has made available the said result, unless there is a question of intent or gross negligence on the part of the Contractor or

Consultant with respect to the assigned activities. B.7 Transferability B.7.1 The rights and obligations vested upon the Contractor or Consultant are personal obligations and are as such not transferable without the prior written consent of NEN. B.8 Invoicing B.8.1 With regards to Article B.3, only the following categories of costs are eligible under this Contract: The costs of the Consultant. The costs of travel and related subsistence allowances incurred by the Consultant B.8.2 A specific Purchase Order (P.O.-number) shall be provided by NEN to the Contractor. Invoices shall mention this P.O.-number, the Project Team designation, the Grant Agreement SA/CEN/GROW/EFTA/515/2016-02 and should be sent to NEN according to the schedule provided with this Contract. Invoices that do not contain these requirements, or are addressed incorrectly, or do not correspond to the invoicing schedule may be considered invalid and may be disregarded. B.8.3 Clearly readable time sheets and clearly readable copies of receipts of the travel and related subsistence allowances shall be provided to NEN. B.8.4 Incomplete invoices from the Contractor, or missing time sheets, or missing copies of original receipts for travel and subsistence allowances, may cause delays in payment. B.9.5 The invoice may not exceed the maximum of 8 hours per day, nor exceed the tendered pricing per hour. Declarations may not exceed the assigned budgets given in the Contract unless overspending the assigned budgets is granted in writing by NEN. B.10.6 Invoices from outside the Netherlands should not include VAT 1. 1 in most cases reverse charge applies B.9 Duty to keep documents and obligation to provide information B.9.1 The Contractor shall keep all original documents, especially accounting and tax records, including receipts from travel expenses made for this Contract, stored on any appropriate medium, including digitalised originals when they are authorised by its national law and under the conditions laid down therein, for a period of five years starting from the date of payment of the balance for the action concerned. B.9.2 This five years period shall be longer if there are on-going audits, appeals, litigation or pursuit of claims concerning the Contract. In such cases, the Contractor shall be informed by NEN and the Contractor shall keep the documents until such audits, appeals, litigation or pursuit of claims are closed. B.9.3 The Contractor shall provide any information, including information in electronic format, requested by NEN, or by any other outside body authorised by it, in the context of technical and financial checks, audits or evaluations in relation to the use of this Contract. B.10 “Force Majeure" and Severance B.10.1 “Force Majeure" shall mean any circumstance beyond the reasonable control of the party affected thereby, which party shall not be considered in breach of Contract or under any liability whatsoever. B.10.2 Without prejudice to the generality of the foregoing and without limitation, the following shall be regarded as such circumstances:

I. Acts of God, explosion, flood, lightning, tempest, fire or accident; II. war, terrorism, hostilities (whether war be declared or not), invasion, act of foreign enemies; III. rebellion, revolution, insurrection, military or usurped power of civil war; IV. riot, civil commotion or disorder; V. acts, restrictions, regulations, bylaws, refusals to grant any licenses or permissions, prohibitions or measures of any kin on the part of any governmental authority; VI. import or export regulation or embargoes; VII. strikes, lock-outs or other industrial actions or trade disputes of whatever nature. B.10.3 If either of the parties is prevented from performing its obligations under this Contract as a result of events or circumstances outside its reasonable control (“force majeure”) then it shall not be in breach of this Contract by reason thereof and time for performance shall be extended by a period equivalent to that during which performance is so prevented, provided that if such prevention of performance persists for more than 8 weeks then the party not affected by such circumstances of force majeure shall be entitled to terminate this Contract forthwith by notice in writing on the other party. B.10.4 Should any paragraph or provision of these General terms and conditions be held to be void, invalid or inoperative, it shall not affect any other paragraph or provision thereof, and the remainder of the Contract and the General terms and conditions shall be effective as though such void, invalid, or inoperative paragraph or provision had not been contained therein. B.11 Entire Agreement and variation B.11.1 This Contract contains the entire agreement and understanding between NEN and the Contractor. B.11.2 This Contract may not be changed, modified, or discharged other than with the written agreement of both parties signed by the Contractor and by NEN. B.12 Confidential Information B.12.1 Any property including intellectual property and Confidential Information provided by NEN to the Contractor or to the Consultant in connection with this Contract shall remain the property of NEN and shall only be used in the execution of the services to be provided under this Contract and for no other purpose without the prior written consent of NEN. B.12.1 During the term of this Contract and for a period of five (5) years after termination howsoever arising, the Contractor or the Consultant shall disclose such Confidential Information only to those people who are directly engaged in carrying out the technical services. B.12.1 For the purposes of this clause, Confidential Information shall not include information that is already in the public domain, is otherwise lawfully known to the Consultant at the time of disclosure, is obtained lawfully from a third party or independently developed by the Contractor or Consultant, or which is required to be disclosed in order to comply with a legal requirement. B.13 Provisions relating to fiscal and social security charges B.13.1 Any corporate or personal tax formalities or social security charges resulting from this Contract for the Contractor or Consultant will be solely born and paid by the Contractor or the Consultant. The Contractor or Consultant shall indemnify NEN. B13.2 NEN and the Contractor explicitly declare that they do not intend to enter into an Employer/Employee relationship between NEN and Consultant. NEN and the Contractor commit to

performing their mutual contractual obligations in accordance with those prevailing for an Engagement Contract. B.13.3 If the Contractor and the Consultant are the same individual: I. The Contractor certifies that he is covered by a social security scheme in the capacity of both Contractor and Consultant, and that he has taken adequate provision to cover the professional risks related to the performance of the present Contract. B.13.4 If the Consultant is an employee of the Contractor: I. The Contractor declares that the Consultant is an employee of the Contractor and shall perform his obligations under this Contract without any bound of subordination to NEN and shall therefore not be deemed to be an employee of NEN. II. The Contractor shall continue to fulfil all legal obligations of an employer (e.g. social service contributions and charges, medical insurance contributions, fiscal charges and other charges which are to be borne by any employer) and in addition shall ensure that adequate provision is made, whether by insurance or otherwise, to compensate the Consultant for any injury or illness suffered by him in the course of the performance of the present Contract.

Annex VIII C. Assignment of exploitation rights C1. In the framework of the Berne Convention for the protection of literary and artistic works: a) By signing this Assignment of Exploitation Rights, the Contractor and the Consultant assign solely, exclusively and irrevocably to Comité Européen de Normalisation (CEN) for the benefit of its national members the exploitation rights in such of their intellectual contributions as are reproduced in the publications resulting from the technical work of CEN, as defined in paragraph 1.2 of CEN Internal Regulations Part 2. This assignment is granted free of charge, and covers the forms of exploitation specified below, throughout the world, for the total duration provided for by law. They accept that exploitation will take place without mention of their name. b) The Contractor and the Consultant experts accept that this assignment does not preclude them from continuing to exploit their own copyrightable contribution for their own purposes provided that such exploitation does not adversely affect the exploitation of the publications specified in (a) above. C2. Should the Contractor or the Consultant offer intellectual contributions for which they do not personally hold the copyright, they undertake to declare this to CEN or an appropriate official of one of its member bodies and to name the holder of the copyright if known to them. C3. These Terms and Conditions are subject to Dutch law. FORMS of EXPLOITATION The assigned exploitation rights cover the right to reproduce, to adapt, distribute, sub-distribute, adjust, translate, rent, lend, derive revenue from duplication and loan, communicate to the public in total or in part, in summary or with comments, transfer all exploitation licences and authorize all subdistribution. The exploitation rights cover all languages and covers all forms of exploitation known at present, in particular and non-restrictively: publication by all means and all graphical support systems, by print, press, photocopy, microfilms, and via all magnetic, computerised and numerical support systems, memory cards, CDRoms (CD digital compact discs), films, photographs, slides, teledistribution, cable, satellite, diskettes and online document servers and networks
