estos son los elementos indispensables para la existencia de un acto jurisdiccional 1. notio
Es la facultad que poseen los tribunales para conocer de un asunto litigioso. El fundamento constitucional de esta se encuentra en el articulo 76, cuando de las facultades de conocer de los tribunales. La facultad de conocer se fundamenta, en que para resolver un determinado conflicto, primero deben conocerse los hechos que constituyen dicho conflicto (oír a las partes y darles la posibilidad de que presenten pruebas) Esta facultad por regla general se ejerce a petición de parte Por excepción los tribunales podrán actuar de oficio para abocarse al conocimiento de un asunto determinado. En este punto debemos hacer la siguiente presición. 1. En materias propias del derecho civil los tribunales siempre conocen un conflicto a petición de parte, salvo las excepciones legales como por ejemplo: la prescripción de la acción ejecutiva. 2.
en materias propias del derecho penal, subdividimos a) en el procedimiento penal antiguo los jueces tenían la facultad de conocer un posible delito, de oficio, esta es una manifestación del principio inquisitivo. b) en el derecho procesal penal (reforma)los jueces no están facultados para conocer un posible delito de oficio, sino que esta facultad recae en el ministerio publico (fiscales) quienes tienen solamente la facultad de conocer pero no juzgar, esta es una manifestación del principio dispositivo .

Corresponde a la facultad de juzgar. Por lo tanto, los tribunales tienen la facultad de dictar sentencia poniendo fin al litigio en forma definitiva (efecto de cosa juzgada) sin embargo, existen otros órganos del estado que conocen determinados conflictos, por ejemplo los tribunales tributarios, que diferentes a los pertinentes al poder judicial, la sentencia de estos no produce efecto de cosa juzgada, ya que quien conoce y falla es un órgano administrativo cuando el juez ejerce la facultad de juzgar, no puede hacerlo fuera de los limites propuestos por las partes en la demanda y en la contestación, si el asunto es civil y en la querella o acusación, si el asunto es penal en efecto si el juez dictase sentencia concediendo mas aya de lo pedido, caería en juicio de ultrapetita o extrapetita fuera de lo pedido. Esto trae como consecuencia que la sentencia adolece de un juicio subsalable con el recurso de casar en la forma 5. ejecutio
corresponde s la facultad de tribunales consistente en hacer ejecutar lo juzgado, en el caso de que alguna de las partes no quiera con las prestaciones que el juez ordeno en la sentencia, por lo tanto esta facultad puede ser ejercida en forma coercible. .
