At the above captioned date and time, the court held a scheduling conference in the above

referenced adversary proceeding pursuant to F.R.Civ.P. 16(b), as incorporated into FRBP 7016,
3
and LBR 7016-1(a). Appearances were entered on the record. The parties having met and

conferred prior to the scheduling conference pursuant to F.R.Civ.P. 26(f), as incorporated into FRBP 7026 and LBR 7026-1, and the court having consulted with the parties at the scheduling

conference, it is ordered: 1. Discovery. Discovery as to all matters, excluding the disclosure of expert witnesses and expert testimony, if any, within the scope of F.R.Civ.P. 26(a)(2), as incorporated into FRBP 7026, and discovery in conjunction therewith, shall be completed not later than August 31, 2018.

Completion means that all discovery has been conducted so that all depositions have been taken,

interrogatories answered, documents produced, admissions made, and any disputes relative to
14
discovery have been resolved by appropriate order, if necessary, and where discovery has been
15
ordered, the order has been complied with in all respects. The deadline for discovery may be
16
extended by the parties by agreement, without an order of the court.

2. Discovery Disputes. Parties are expected to attempt to resolve discovery disputes
19
without judicial intervention by conferring in good faith. In any motion filed with reference to a
20
discovery dispute, the parties involved must certify that they have made a reasonable effort to
21
reach agreement on disputed matters.

If a party files a motion with reference to a discovery dispute, the parties must submit
23 24
evidence of the fees and expenses incurred in presenting or opposing the motion so the court can
25
make an award contemporaneously with its ruling on the discovery motion, as contemplated by
26
F.R.Civ.P. 37.

Any dispute regarding discovery, including but not limited to, any motion under

F.R.Civ.P. 37, as incorporated into FRBP 7037, to compel discovery or to seek sanctions for

failure to make discovery, must be resolved not later than the applicable deadline for discovery
4 5
fixed in section 1 of this order. 3. Status Conference. A continued Status Conference is hereby set for 10:30 a.m. on
6 7
September 18, 2018. An updated Joint Status Report must be filed with the court not later than
8
7 days prior to the continued Status Conference pursuant to LBR 7016-1(a)(2).
