Glossary ACCIDENT An unforeseen, unintended event.

ADJUSTER (OR EXAMINER) A representative of the corporation who seeks to determine the extent of liability for a loss when a claim is submitted.

BODILY INJURY Physical injury to a person, including death.

CLAIMANT A person who makes a claim.

DEATH BENEFIT Amount paid to the beneficiary upon the death of a claimant as a result of injuries sustained in a motor vehicle accident.

FINANCIALLY IRRESPONSIBLE MOTORIST The owner, operator, or other person legally responsible for the operation of an uninsured motor vehicle or vehicle involved in an accident resulting in personal injury or death who did not have in effect at the time of such accident either: A valid and collectible policy of bodily injury liability and property damage liability insurance or bond with applicable limits at least equal to those specified in section 311 of the vehicle and traffic law; or a certificate of self insurance issued by the department of motor vehicles pursuant to section 316 of the vehicle and traffic law; or who has not otherwise complied with the provisions of section 312 of the vehicle and traffic law; or who does not have in effect at the time of such accident a valid and collectible policy of bodily injury liability and property damage liability insurance with applicable limits at least equal to those specified in section 25.13 of the parks, recreation and historic preservation law.

HOUSEHOLD AFFIDAVIT (HHA) Required form to inform that a claimant resided at a specific residence when the loss occurred, and whether or not that claimant resided with any other person(s) at that residence. INSURED MOTOR VEHICLE A motor vehicle as to which there is maintained proof of financial security as defined in subdivision 3 of section 311 of the vehicle and traffic law or section 25.13 of the parks, recreation and historic preservation law.

INSURER Any company authorized by the superintendent to do any form of motor vehicle liability insurance business in this state.

LIABILITY Legal responsibility to another for one’s negligence that results in injury or death; an obligation for paying the debt or settling a wrongful act that may have been committed.

LIABILITY LIMIT Maximum amount of coverage available per claim.

LOSS The amount that is paid on a claim.

MOTOR VEHICLE A motor vehicle as defined in section 125 of the vehicle and traffic law and also includes trailers, semi-trailers, motorcycles, tractors and snowmobiles as defined in subdivision 3 of section 21.05 of the parks, recreation and historic preservation law and shall exclude fire and police vehicles, self propelled combines, self-propelled corn and hay harvesting machines and tractors used exclusively for agricultural purposes.

NOTICE OF INTENTION FORM (NOI) Required form to notify MVAIC that a claimant is pursuing a claim through the company. This form must be completed fully, signed and notarized. (Notice of Intention (/uploaded/documents/Notice%20of%20Intention%20to%20Make%20Claim.pdf)- PDF Version)

OTHER EXPENSES Shall consist of all reasonable and necessary expenses, other than medical expense and work loss, up to $25 per day for a period of one year from the date of accident causing injury.

PERSONAL INJURY PROTECTION Pays basic expenses for a claimant in states with no-fault auto insurance. No fault laws generally require drivers to carry both liability insurance and personal injury protection coverage to pay for basic needs of the individual, such as medical expenses, in the event of an accident.

PROOF OF RESIDENCE Documentation reflecting the claimant’s residence when the loss occurred.

QUALIFIED PERSON (i) a resident of this state, other than an insured or the owner of an uninsured motor vehicle and his spouse when a passenger in such vehicle, or his legal representative, or (ii) a resident of another state, territory or federal district of the United States or province of the Dominion of Canada, or foreign country, in which recourse is afforded, to residents of this state, of substantially similar character to that provided for by this article, or his legal representative. It does not include any operator of or passenger on a snowmobile. In this subsection, “operator” means every person who operates or is in actual physical control of a snowmobile, whether or not it is under way.

UNINSURED MOTOR VEHICLE A motor vehicle other than a motor vehicle described in subsection (c) hereof.

WORK LOSS Available for up to a maximum payment of $2,000 per month for a maximum period of three years from the date of accident. See Regulation 68 (http://www.dfs.ny.gov/insurance/r68/r68_new.htm)for eligibility.
