RESOLVING ISSUES BETWEEN THE PARTIES This is "Family Law!" There is NO insurance company to write you a big check at the end! If you are getting divorced, the less money you spend on attorney's fees, the more money you have to divide between yourself and your spouse! Whether or not your spouse has an attorney, I have a strong reputation for settling cases without the need for trial. Less time in Court means less money spent in attorney's fees and a higher rate of satisfaction with the outcome of the case, because you know better than anyone (including the Judge) what is most important to you. I use my knowledge and experience as a Houston Divorce Lawyer to protect your rights; to make certain ALL issues are resolved; and to make sure that the final Orders accurately reflect the parties' agreements, and that they are written in a way which is legally enforceable and in a manner which will be approved by the Court.

UNDERSTANDING AND COMPASSION I understand how difficult it is to go through a divorce -- even if you were the one who made the decision to end the marriage. Our entire staff is here to support you. I do my best to be efficient and organized -- to be as considerate as I can of your time -- to give you as much notice as possible regarding Court, mediation or other deadlines -- and to be clear about "what information I need from you" and the date by which I need it.

I regret that I cannot make this process painless -- but I will do my best to get you through it without our adding to your stress.
WHILE THE DIVORCE IS PENDING.... If your divorce is "uncontested," you and your spouse will decide between you how to handle matters while your divorce is pending. Of course, I will help you as needed. I will calculate your child support amount, for example. But, you will not need to go to a Court Hearing for Temporary Orders.
WHAT IF IT'S DOWNRIGHT UGLY? Unfortunately, sometimes your divorce will require a tough, aggressive legal approach. Even in these cases, you can be confident that I will use my negotiating and mediation skills to obtain the best result. I have a reputation with the Court for representing our clients with integrity. I have a reputation with our opposing counsel for being "strait shooters!" Because they can rely on me to "say what I mean" and "do what I say," it makes it easier for me to come to agreements with other attorneys. The Court also knows that they can depend on the information I provide because I am known for being thorough, honest and accurate. If a Court hearing and / or trial becomes necessary, be assured that I wll fight hard on your behalf. I am committed to be knowledgeable, organized and prepared, and to work diligently to get the best possible outcome. I know what I want BEFORE I get to Court, and my "advance preparation" makes the Judge's decisions easier to make and, more likely, favorable to my client. In those cases in which no settlement was reached, the parties may go to Divorce Mediation prior to final trial. In this situation, I make sure to be "trial ready" when I attend the mediation. (Formal mediations only occur in "contested cases," ie. those in which each party is represented by his and her own individual attorney.) I always make certain my client understands the process, and I will meet in advance to answer any questions, update needed information and to outline our position and to formulate specific goals and strategies. This should be differentiated from those situations in which Mr. Schmidt of this firm is hired NOT to represent our client as his or her attorney, but instead to act as the Houston Divorce Mediator himself in order to facilitate an agreement between two spouses and their respective Houston divorce lawyer. CASES OTHER THAN DIVORCE Of course, my office also deals with other types of Family Law Cases. I would be happy to meet with you for an attorney consultation on any family law matter. I ask that you bring with you any Court Orders, if any, or other documents which might be pertinent to your issues (ex. I.R.S. returns and paystubs -- if your issue is "child support). Due to the nature of these types of matters, I do require a consultation fee in these cases. Often, you will receive all the legal advice you will need during this single consultation.
