My Best Day Is Yet To Come Steiner Sports and the 29th Annual HIA-LI Trade Show & Conference By Janine M. Mejeur-Haas Mejeur-Haas Communications, Inc. www.mejeurhaas.com The HIA-LI commenced its 29th annual B2B trade show and conference with a magnificent breakfast and a very special guest, Brandon Steiner, founder and CEO of Steiner Sports. Steiner regaled the members in attendance at the Suffolk County Community College Sports Complex with stories of the origin of his unique company and of his humble beginnings in Brooklyn. HIA-LI president, Terri Alessi-Miceli, opened the event by announcing that the show had been sold out and that the thousands who would attend were in for many “great experiences” throughout the day, the first of which would be an address by the sports memorabilia legend himself. “We know Brandon and know him to be a humble man. He has asked to deliver his talk from the floor rather than from the stage so that he can be among you,” Alessi-Miceli said in introduction. “Even the honorarium paid to Brandon for his appearance here today will be donated to the Boy’s and Girl’s Club.” With a stake of four thousand dollars and a Mac computer, Steiner started Steiner Sports ever

In those seconds of creativity, he advises that we think about what’s really important, the positive things in life and push away thoughts of negativity. “Winning is important and I love to compete,” he said.

In a year’s time the HIA-LI will be celebrating the 40th anniversary of the trade show and, undoubtedly just like Brandon Steiner, will be expecting that its best day is still “yet to come.”

But, even though his entire life has been about winning, Steiner still recognizes the importance of humanity in his business and personal life. “Every single day, I perform two acts of kindness – two separate things for two different people.” Steiner left the audience with two final thoughts, “Never eat ballpark food before the end of the third inning because it might be left over from the day before and never take a cellphone with you on date night.” From this we might infer that the man has maintained his youthful exuberance by daily

The 2017 HIA-LI trade show luncheon featured updates by several prominent individuals involved in Long Island’s Economic Revitalization projects. HIA-LI president Alessi-Miceli proudly announced that the show was sold out with over 3000 people expected throughout the day, “We welcome our distinguished panel who will discuss the future of Long Island and the development of vibrant communities where we can live, work and play.” She then introduced New York Senate Majority Leader John Flanagan, “Every single time I come here I’m amazed at the breadth and scope of the businesses located here.” He reiterated that his offices were dedicated to fostering the economic climate that would promote prosperity. “Last I checked, we live in a capitalistic society. We want you all to do well.” President Alessi-Miceli then welcomed Suffolk County Executive Steve Bellone. “Terri does a great job and has assembled an amazing panel,” praised Bellone. He went on to review exciting new projects on Long Island and in Suffolk County: the expansion of our transportation infrastructure at Penn Station, the LIRR third track and East Side Access projects that will allow

people to move to and from New York City and Long Island and providing the human capital necessary for Long Island businesses to thrive. “We have never been in a better position to retrofit suburbia for the twenty-first century,” said Bellone. “The park is critical to the region and is one of the best in the country,” he added. Terri Alessi-Miceli then moved on to the panel and introduced moderator Mitch Pally, CEO of Long Island Builders Institute. Pally announced funding for three important rail projects which would increase LIRR capacity by 40% and the beginning of Frontier Airlines to service MacArthur airport this summer. “This is a tremendous success story,” he concluded.

“The market is there,” Monti declared. “When we do things right, it will keep young people here and attract others.” This includes developing “walkable” neighborhoods which command an approximate 150% rent premium over nonwalkable.

Joe Campolo, Managing Partner at Campolo, Middleton & McCormick gave attendees a rundown of key points in the 2017 Hauppauge Industrial Park Economic Impact Study: 11 square miles generating nearly $13.5 billion in sales; 1,350 businesses and growing; 55,000 employees providing 5% of the jobs on Long Island; combined payroll of $2.9 billion resulting in $2 billion in disposable income; business expenses of $4.4 billion dollars to spend in the region; and $64.5 million in property taxes. “Astonishingly, all of this takes place in the shadow of New York City,” Campolo marveled.

Jim highlighted the successful completion of Patchogue New Village as a template for the future of downtown development and plans to duplicate that success with the Ronkonkoma project. Phase 1 of the 53-acre project is expected to break ground this June and provide 489 units of multi-family housing, create a downtown area around the train station and optimize its proximity to the airport.

Don Monti, CEO of Renaissance Downtowns discussed the company’s $1.5 billion project in the Town of Glen Cove, a $2.5 billion project in Hempstead and further expansion taking place in Huntington. The total impact of these projects amounts to 23 million square feet of development with 14,000 residential units and nine million square feet of mixed-use space.

Further observations on real estate came from Tritec Real Estate Co., Inc Principal and Long Island native, Jim Coughlan. “Retail space has to be viewed now as more of an experience,” Coughlan commented. “People of all ages want to use space differently now from the way it was used 20 years ago.”

The Albanese Organization was represented on the panel by senior vice president Marty Dettling. The company is currently moving forward as master developers in the revitalization of the town of Wyandanch. The town brought the company in as the master developer “not just to gentrify the community, but to lift it up,” Dettling said. “What we have created is affordable housing that I would love to live in,” Dettling asserted. It’s a bright tomorrow for Long Island, Suffolk County, and the Hauppauge Industrial Park. The HIA-LI is proud to have been a part of the past and is working hard to deliver the future.

The gift of adversity visited the Hauppauge Industrial Park in the form of a three-day power outage in 1978. For Jack Kulka, it had become three days too many. Kulka assembled a group of civic-minded Long Island business leaders to take action and the HIA-LI was born. No one, not even Jack, could have predicted the profound impact this event would have on Long Island some 39 years later. The Overlay District David Flynn, Town Planning Director for Smithtown, explained the overlay district which covers about two-thirds of the park. “Zoning was getting to the point where it was an impediment to growth rather than a stimulant, so in 2015 we worked out a draft amendment to the ordinance to facilitate growth,” Flynn remarked. The new overlay permitted higher building, parking garages as accessory to certain uses, and outdoor storage (with special permit). Flynn stated that they are now working on an amendment to allow mixed use in buildings to become “more competitive with Silicon Valley.” It is currently under environmental review. In closing, Jack Kulka once again pointed out the urgency in all of these matters.

Tell us about how you/your company started. Evan Leonard and lifelong friend David Tan started an IT firm out of Hofstra University’s J.C. Adams Playhouse. CHIPS got its start by implementing and supporting Hofstra’s first computerized ticketing system. From there, CHIPS added email solutions and connecting networks to the internet. Quickly after, CHIPS created their first Managed Services practice to help maintain company’s networks. Single Stream Recycling a reality in Suffolk County HIA-LI’s Environmental/Green Industries Committee Corner By Lilia Factor, Co-chair of the Environmental/ Green Industries Committee What happens to the paper, plastic and aluminum that you put out on the curb on recycling day? On May 9, 2017, the members of the HIA-LI Environmental/ Green Industries Committee learned the answer to this question by going on a tour of the Town of Brookhaven’s recycling facility, located at 352 Horseblock Road in Yaphank. The facility underwent significant upgrades about three years ago to equip it for “single stream recycling”. This enables residents to put all of their recyclables into one container, which is picked up by the municipality and brought to the facility for sorting. There, the mixed recyclables are loaded onto a long conveyor system that takes them through various filters,

photo sensors, and quality control stations. At the end, the different types of plastic, paper, cardboard, and aluminum are separated and baled, the glass is crushed, and the large pieces of metal are collected for sale as raw commodities. The private company running the operation is Green Stream Recycling, a company owned by Winters Brothers and Omni Westbury. By agreements with the Town of Brookhaven and others, Green Stream pays different rates for the materials it takes in and is responsible for processing and selling the end products. Other towns, including Southold, Smithtown, Huntington and Glen Cove, also bring their recyclables to the Yaphank facility, bringing its total intake to 5,700 - 6,000 tons per month. With the capacity to handle up to 35 tons of materials per hour, Green Stream is still looking to contract with additional municipalities in Nassau and Suffolk. One problem repeatedly mentioned on the tour and plain to see on the conveyor was the profusion of plastic bags, which are not supposed to be disposed of in the recycling bins. Although plant employees try to remove the bags at the beginning of the sorting process, many bags get through the manual screening and are caught up in the rotating parts of the conveyor system. As a result, the equipment must be halted and manually cleaned several times a day. The correct way to handle plastic bags is to use fewer of them, re-use them for regular waste, or take them for recycling at special receptacles placed in supermarkets. The facility operators also ask that residents empty containers before putting them into the bins. This reduces clogging and sanitation problems. Who buys the separated recyclables? A lot depends on the market for these commodities, with prices changing daily. Some of the material is packed into ship contain-

ers for transport to China. Aluminum and tin is currently being sold to U.S. and Canadian buyers. Large steel items are collected by a local vendor. Glass is crushed and used in construction and as cover material, including at the adjacent Brookhaven landfill, which accepts construction and demolition debris and incinerator ash. According to Nicole Pocchiare and George Bateman, who led the tour, the single stream system has facilitated a 25% increase in recycling rates in Brookhaven. However, there is still a long way to go. It is estimated that recycling, composting, and changes in packaging materials can reduce our garbage by 75%, which would go a long way to reducing incineration on Long Island, as well as truck traffic taking trash to landfills in other states.

You will never achieve what you want eed to share some bad news. Chances are you’ll never find the happiness you’re seeking in life. In fact, you’ll most likely never reach your financial, health or personal goals. Before you start cursing me, allow me to explain.

accomplishing something most people will never have. Here’s a question, are your goals really yours? Do you allow your dreams to be dictated by societal standards or by the way you’re judged by others?

In the beginning, we all set out to climb a mountain but when life gets in the way we settle for what’s more “realistic”. Fact is, you have the potential to achieve anything you desire if you choose to. Let me rephrase that: commit to. We all want to be the best version of ourselves, whether that means having a six-pack, making vast amounts of money or just being happy. Unfortunately, what most people lack is patience and the endurance needed to succeed in spite of pain.

I ask new entrepreneurs three simple questions before they get started. “How much money do you need to earn in the next six months to make it worth your time?” Notice I didn’t say 5 years? I want to measure their short-term expectations. I can adjust the “pain” of the next question accordingly. “How much time are you willing to commit each day to achieving that goal?” The key here is committing regardless of how tired you are. It doesn’t matter whether the kids are sick or that you have other obligations. You must be willing to commit one hundred percent and stick to it. Finally, I’ll ask them “How many months are you willing to commit that time with zero return?” This is the most important question. We live in a world of instant gratification but reality dictates that things don’t come easily or quickly.

It really comes down to two words…pain tolerance. Although, it can be said that pain is a very subjective word. Ask anyone about the physical pain threshold a woman develops during childbirth. Pain is not only defined by the feeling conveyed by sensory neurons, it’s also the perception of discomfort. We crave pleasure (outcomes), but avoid the pain. Very few rewards in life will come without pain. Of course, we can model from others to avoid certain mistakes or lessen the pain but if you’re looking for the easy street to achieve your personal or professional goals, keep dreaming.

Another important point is that you assess what you want from each of your goals. It’s not the money you want because that’s paper. You want the perceived freedom it gives you. Do you really need a six-pack? Fully clothed, nobody would be any the wiser. What you want is the feeling you have of

But if you don’t have a workable succession plan, there’s likely to be a big hole in your planning. “A lot of people confuse succession planning with estate planning,” says Dr. Edwin Hoover, a family business advisor based in the Chicago area. “They think that if they have an estate plan, they’re all set.” The two processes, however, are very different. The estate plan is all about an individual deciding who gets what when he or she dies. The succession plan is all about the survival of the business. That makes succession planning a group process since all parties need to be at the table. “Business owners who are used to doing things on their own often find this very frustrating,” Hoover says Moreover, family dynamics with the accompanying psychological and emotional issues can make succession planning a complex process. It can also be a treacherous one. According to the Family Firm Institute, only about a third of family businesses successfully navigate the transition to the next generation. The reason: poor planning, unresolved family conflicts or the lack of estate preparation, says Hoover.

Good planning takes time. Hoover, for example, recommends, starting 10 years in advance of any expected change in management. That provides ample time for the family, the business, the new management and the outgoing owner to work together in crafting a successful transition. Of course, sometimes an owner decides it’s better to sell, particularly if none of the kids are interested in taking over. Before putting the family’s full service car wash on the market, for example, Karen Colcagno and her husband asked all three of their kids if they had any interest in taking over. They didn’t. “They were bursting with ideas of their own,” says Calcagno. “We ended up finding a great buyer.” Now a business coach and founder of the Advantage Family Business Center, Calcagno says money from the sale was used to buy a building which family members now manage together. “A lot of people don’t think of that as succession,” she says. “But it conserves the family wealth and creates a more even playing field for the kids.” Good communication is a critical part of the succession planning process. People need to make sure that family members, business partners and employees all understand the plan. “The person who owns the business is the one who makes the ultimate decision,” says Hoover. But the future success of the company will depend on the people who are taking over. That means the details of the transition need to be clear to all involved.

Insurance can also fund buy-sell agreements in case of death or disability and may supplement retirement income.* Too often, owners never get around to funding their succession plans. Others don’t pay enough attention to the funding details, while still others put their plans in place and forget to update them as things change. The result: family members and business partners may find they have insufficient financial resources to actually implement the plan. Succession planning is an ongoing process, as Calcagno has discovered. After the sale of the family car wash, her husband created a business of his hobby restoring vintage Corvettes. Now he has 10 buildings filled with classic car parts, but no one yet in line to take over the business. “We haven’t come to a conclusion about how that should be managed,” Calcagno says. But it’s definitely on the list. *Access to cash values through borrowing or partial surrenders will reduce the policy’s cash value and death benefit, increase the chance the policy will lapse, and may result in a tax liability if the policy terminates before the death of the insured.

It is the funding, however, that provides the glue needed to make a succession plan work. Life insurance is commonly used to make sure that kids in the business aren’t favored over those who choose other professions.

You might think that those who are rich and famous would be way ahead of the curve when it comes to planning their estates properly, considering the resources and lawyers presumably available to them. Yet, there are plenty of celebrities and people of note who died with inadequate (or nonexistent) estate plans. No estate plan It’s hard to imagine why some famous people left this world with no estate plan. A case in point involves former entertainer-turned-congressman Salvatore Phillip “Sonny” Bono. He died in a skiing accident in 1998, leaving no will or estate plan of any kind. His surviving wife had to petition the probate court to be appointed her deceased husband’s administrator, seek court permission to continue various business ventures in which Sonny was involved, and settle multiple claims against the estate (including one from Sonny’s more famous prior spouse, Cher). To make matters worse, a claim against the estate was brought by a purported extramarital child, which necessitated a DNA test from Sonny’s body to determine whether he’d fathered the claimant (he did not).

Do-it-yourself disaster We’ve all seen the ads for do-your-own legal documents, including wills and trusts. And the law does not require that you hire an attorney to prepare your will. But even the highest ranking jurist of his time should have relied on estate planning experts to prepare his estate plan. Instead, U.S. Supreme Court Chief Justice Warren E. Burger, who died in 1995, apparently typed his own will (consisting of only 176 words), which contained several typographical errors. More importantly, he neglected to address several issues that a well-drafted will would typically include. His family paid over $450,000 in taxes and had to seek the probate court’s permission to complete administrative tasks like selling real estate.

Florence Griffith Joyner died at the young age of 38, but her husband claimed he couldn’t locate her will, leading to a dispute between Mr. Joyner and Flo Jo’s mother, who claimed the right to live in the Joyner house for the rest of her life.

The importance of updating your estate plan Sure, formulating and executing an estate plan is important, but it shouldn’t be an “out-of-sight, out-ofmind” endeavor. It’s equally important to periodically review your documents to be sure they’re up-to-date. The problems that can arise by failing to review and update your estate plan are evidenced by the estate of actor Heath Ledger. Although Ledger had prepared a will years before his death, there were several changes in his life that transpired after the will had been written, not the least of which was his relationship with actress Michelle Williams and the birth of their daughter, Matilda Rose. His will left everything to his parents and sister, and failed to provide for his “significant other” and their daughter. Apparently his family eventually agreed to provide for Matilda Rose, but not without some family disharmony.

So What Happens If You Struggle to Get Things Done? Developing the habits of diligence and consistency are just like developing physical muscles: your strength will come as a result of consistent struggle. Joining Together to Respond to Poverty and Food Insecurity on Long Island Paule Pachter Chief Executive Officer Long Island Cares, Inc. www.licares.org (631) 582-3663 In a recent report published by the Long Island Association entitled; Poverty on Long Island: It’s Growing, as of 2015, the number of people living on Long Island whose annual incomes are below the federal poverty level of $24,250 for a family of four has increased by 32,953. According to the report, this figure would equate to 185,415 people living in poverty on Long Island. Since the federal poverty rate doesn’t distinguish the cost-of-living rate by region the LIA factored this into their report by adjusting the rate upwards by 30% which resulted in a total of 241,408 people living in poverty in Nassau and Suffolk Counties. By reconfiguring the federal poverty rate from $24,250 to $31,382 for a family of four we’re still missing the mark in attempting to define poverty on Long Island.

There’s no surprise to the LIA findings that there is less poverty in Nassau than in Suffolk. Suffolk has more land to develop affordable rental apartments, the cost of gas is less than in Nassau, there is more industry in Suffolk therefore more job opportunities. Anytime, the business community shines a light on the issue of poverty is a positive sign that our region recognizes the problem and its impact upon our local economy. Living in poverty or living poor is not good for the Long Island economy. Public entitlement programs such as SNAP, Medicaid, public assistance, Medicare and others are limited in relation to what a person can afford. Living poor requires a family to purchase only the necessities, and when more is needed such as food, clothing, personal care items and household supplies, they might turn to the local food pantry, soup kitchen or

other social service program. Right now, approximately 210,000 people earning between $31,282 and $60,500 a year are turning to the emergency food network supported by organizations like Long Island Cares based upon a report by Feeding America that describes a total of 316,000 Long Islander’s impacted by food insecurity in 2016. We cannot end poverty on Long Island and so far, we’ve not been able to lift too many of the “working poor” out of their situations with good paying jobs and affordable housing but, we can make a difference for our neighbors in need of food. As a member of the HIA-LI, you can participate in the HIA-LI Summer Food Drive from June 1 through August 31 by donating non-perishable food or writing a check. The business community can come together to make sure that those in need have access to the basic necessity of a healthy meal on their table just by donating a box of cereal, can of tuna, package of pasta, jar of tomato sauce, bag of rice or by donating $10.00 which can provide 12 nutritious meals for a family in need. Trying to describe poverty on Long Island requires that we strike a balance between what the policies state and what is happening in actuality. In actuality, people living at 200% above the federal poverty level or earning $48,500 for a family of four are living poor on Long Island. In fact, an individual earning $48,500 on Long Island is part of the growing number of the “working poor.” A young professional earning $933 per week and having to pay for a monthly ticket on the LIRR, purchase clothing, food, gas, pay for car insurance, health insurance and have a social life is still living at home with his/her parents and struggling on Long Island. If you take away the cost of an LIRR ticket and apply that

to an average monthly rent of $1,800 for a one bedroom apartment, that person cannot make it on Long Island alone. Compound this by a family with 1-2 children, and even add an additional $12,000 to their income of now $60,500 annually, and that family is still living poor on Long Island when factor in expenses.

The topic of fiduciary liability has come to the forefront recently for plan sponsors. Not just as a result of the Department of Labor’s enactment of their “Fiduciary Rule,” but in a litany of lawsuits. The majority of these suits have been filed by plan participants against their plan sponsor. Some have been settled, others have headed to trial, and still more are expected in the legal pipeline. These lawsuits target both large ERISA plans (e.g. Fidelity’s 401(k) and Columbia University’s 403(b)) and smaller plans with less than $100 million in plan assets. The suits tend to drag on for months, if not years, at a significant cost of time and treasure. The main impetus behind these suits is usually an alleged breach of fiduciary duty, which can stem from a variety of reasons, including: alleged overpayment due to improper investment share class; stock drop issues; and investment underperformance matters. Fidelity Bonds Fidelity Bonds stem from the Employee Retirement Income Security Act of 1974 (ERISA), which requires most every fiduciary or fund-handler of an employee benefit plan (e.g. the CFO who oversees a company’s 401(k) plan) be bonded. The law is black and white. However, the main issue is that often individuals involved with the decisions and operations of an employee benefit plan are simply

unaware of the fact that by law, or by certain actions, they have become a fiduciary under ERISA. As such, they remain unbonded, which can create systemic issues down the line. The point of Fidelity Bonds is truly to protect both the plan, and the individuals involved in the plan, from acts of dishonesty and fraud. There are several factors that determine the amount of bonds required and a variety of providers of these bonds. Fiduciary Insurance Fiduciary Insurance may sound similar to Fidelity Bonds, but is, in fact, quite a separate matter altogether. This specialized insurance protects plan fiduciaries against losses caused by a breach of fiduciary duty. Fidelity Bonds, again, are intended to prevent against acts of fraud or dishonesty. Fiduciary Insurance helps remove some of the risk from these lawsuits by providing coverage that fills in the gaps of traditional coverage (e.g. general liability’s employee benefits liability section or directors and officers insurance). Most plan sponsors don’t realize the remaining exposure from breach of fiduciary duty that still exists even with these other coverages in place. While Fiduciary Insurance is not explicitly required under ERISA, if a lawsuit is filed, both named and subsequently determined fiduciaries may be forced to pay for their own lawsuit defense and any judgments or settlements out of pocket. This can include the attachment of judgments to personal assets. Hiring an Investment Advisor One way to mitigate fiduciary liability is to hire a 3(21) or 3(38) fiduciary. This should be codified in your management agreement and in an Investment Policy Statement (IPS) to document the processes

and procedures around who is responsible for making investment decisions and why those decisions are being made. Note that under ERISA’s 404(a)(1)(B) plan sponsor fiduciaries are required to exercise the highest standard of care. The law mandates that these fiduciaries act: “With the care, skill, prudence, and diligence under the circumstances then prevailing that a prudent man acting in a like capacity and familiar with such matters would use in the conduct of an enterprise of a like character and with like aims.” When deciding to outsource fiduciary liability it is important to understand the differences between fiduciary types under ERISA. A truly outsourced investment fiduciary under ERISA is identified as a Section 3(38) fiduciary, so named for the 38th definition in the ERISA law. However, all fiduciaries for a retirement plan also fall under the definition of a Section 3(21) fiduciary. The primary difference is that a 3(21) and 3(38) fiduciary is that the former makes “recommendations” on plan assets with the employer/plan sponsor having the final decision. In contrast, a 3(38) fiduciary has control and management of the plan assets fully delegated to them. Again, the complexities, vagaries and nuances of fiduciary rules under ERISA, combined with the severe consequences for even inadvertent violation, seem to mandate work with a true and knowledgeable fiduciary such as Endeavor Financial Planning.
