She further informed the board that they just completed their Department of Health financial and case audit. On June 27, they will present at the DOH summit.

Dr. Newman thanked the board staff for their assistance and thanked the board staff. Ms. Johnson and Ms. Forst were chosen as delegates to attend the NCSBN Delegate Assembly and Annual Meeting on August 16-18 in Chicago. B. Board Members Dr. Glymph represented Nursing at the joint meeting in Orlando with Medicine, Pharmacy, Dentistry, and Osteopathic Medicine where they discussed wrong-site surgery, the opioid epidemic, and anesthesia issues. The surgeon general was also present at the meeting. Dr. Hubbard also attended the joint board meeting. She will be attending the NCLEX meeting in Chicago on June 19 and 20th. Ms. Whitson also attended the joint board meeting. Ms. Desmond received the excellence in Nurses Operation award. 38| Page

1. Rules Reports- Board Counsel discussed the need for the Board to decide if they have any rules they would like to include as a Notice of Non-Compliance, which will be discussed in more detail at the Long Range Planning Meeting later today. A motion was made by Newman to allow Ms. Guillemette to draft a letter to JAPC stating that the Notice of Non-Compliance is pursuant to Chapter 456, FS. April 2017 May 2017 2. Litigation Update- Ms. Guillemette informed the Board that there is one case currently at DOAH- a licensure applicant who was educated outside of the US and her education was not deemed equivalent to an RN, only an LPN. D. Prosecution Services Unit

Mr. Witters gave a brief prosecution report for the Board. A motion was made by Newman to allow PSU to continue to prosecute cases that are over a year old. Motion passed unanimously.

6. Enhanced Nurse Licensure Compact (eNLC) a. Rule 64B9-3.002 (1)(d), FAC: English Competency The Board Members and Ms. Guillemette discussed the current English Competency requirement, and the needed changes to align with the current requirement in the Compact. Ms. Guillemette and Board Staff will work together to provide more detailed information for the August meeting for possible revision. b. Rule 64B9-7.001, FAC: Fees A motion was made by Newman to approve the proposed fees of $75 ($50 processing, $25 upgrade). Motion passed unanimously. Discussion ensued regarding the possible need for a Statement of Estimated Regulatory Cost (SERC) before the fees could be set. Mr. Baker also advised the Board that the new eNLC law doesn’t give the BON rulemaking authority on fees for the eNLC. i. Revised RN/LPN Applications A motion was made by Newman to approve the proposed updates to the existing applications and the new Multi-State Upgrade applications. Motion passed unanimously.

B. Educational Tools 1. Determination of PSU Recommendation for Closing Orders at PCP Mr. Witters provided the Board Members with insight regarding the scenarios in which PSU recommends closing cases at PCP. There was discussion between Board Members regarding cases being dismissed with insufficient evidence and Ms. Gustafson advised the Board that they will still have to review those cases in order to make a recommendation during the panels.

C. 2017 Legislation Implementation 1. Chapter 2017-23, Laws of Florida a. Required CE- Human Trafficking i. Amending to Include Territories & Districts A motion was made by Glymph to align the language in S. 464.203, FS to the language applying to Nursing Endorsement from other Districts and Territories. Motion passed unanimously. 2. S. 464.204(1)(b), FS: Denial, Suspension, or Revocation of Certification; Disciplinary Actions A motion was made by Newman to remove the word “intentionally” from S. 464.204(1)(b), FS. Motion passed unanimously. 3. Guidelines for CNA Standard of Care Violation A motion was made by Newman to add “standards of care” for RN, LPN and CNA by rule. Motion passed unanimously.

F. Other Items for Discussion 1. Fiscal Year 2016-2017 Nursing Renewal Fee Proposal- A motion was made by Newman to approve the proposed reduction of renewal fees as recommended in scenario #2. Motion passed unanimously. 2. June 2nd MQA Multi Board Workgroup Meeting – Orlando. Mr. Baker gave a brief synopsis of the Multi Board workgroup and let them know there will be more meetings over the next few weeks as a result of the workgroup. 3. Fiscal Year 2016 CORE Aggregate Report- informational 4. Reporting Discipline to NPDB - Yes or No? Mr. Baker gave an overview of the criteria for discipline reporting to the National Practitioner Data Bank by adding a Reprimand to all settlements or final orders. A motion was made by Glymph to not report all discipline to the Data Bank. Motion passed 5. Criminal History Guidelines Revision - Tiffany Robinson provided an overview of the proposed revisions to the current Matrix. A motion was made by Newman to accept the proposed updates. Motion passed unanimously.
