Dr. Martha Brown was present on behalf of the Professionals Resource Network, Inc. (PRN). Students from Concorde Career Institute were present. To accommodate individuals wishing to address the Board, the Board Chair may adjust the sequence of the agenda items. The minutes reflect the actual sequence of events rather than the original agenda order. DISCIPLINARY PROCEEDINGS Due to participation in the Probable Cause Panel, Ms. Nunez was recused from tab 1, Mr. Fields was recused from tabs 1, 2, 3 and 5, and Mr. Hendriksen was recused from tab 4.

MOTION FOR BOARD’S FINAL ORDER AFTER HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT TAB 1 Lawrence E. Randall, RRT, DOH Case No: 2012-17417 Informal Hearing, (PCP –Barrett, Nunez and Fields) Respondent was not present nor represented by counsel. Ms. Gilani summarized the case for the Board. Respondent was charged with the following violation: Section 468.365 (1)(w), Florida Statutes (2012), by being unable to deliver respiratory care services with reasonable skill and safety to patients by reason of the use of alcohol or drugs. The case was presented as a Hearing Not Involving Disputed Issues of Material Fact, which requires the Board to impose whatever discipline upon the Respondent’s license that the Board deems appropriated and to assess costs of the investigation. MOTION: Ms. Sherrod made a motion to make a finding that the Respondent was properly served and has requested an informal hearing. The motion was seconded by Dr. Friday-Stroud and carried 3/0. MOTION: Dr. Friday-Stroud made a motion to adopt all material in this tab and any addendum materials into evidence of this proceeding. The motion was seconded by Mr. Hendriksen and carried 3/0. MOTION: Dr. Friday-Stroud made a motion to adopt the findings of fact as set forth in the Administrative Complaint. The motion was seconded by Mr. Hendriksen and carried 3/0. MOTION: Dr. Friday-Stroud made a motion to adopt the conclusions of law as set forth in the Administrative Complaint and find that this constitutes a violation of the Respiratory Care Practice Act. The motion was seconded by Mr. Hendriksen and carried 3/0. MOTION: After discussion, Dr. Friday-Stroud made a motion to impose the following penalties: • •

Suspension of License until Respondent presents a favorable evaluation from PRN stating he is able to practice with reasonable skill and safety; and comply with a PRN monitoring contract, if applicable. Costs of $2279.41 to be paid within one (1) year of the filing of the Final Order

The motion was seconded by Mr. Hendriksen and carried 3/0. MOTION: Ms. Nunez made a motion to access the costs of $2279.41 to be paid within one (1) year of the filing of the Final Order. The motion was seconded by Ms. Sherrod and carried 3/0. TAB 2 Rafael Alfredo Bocanegra, RRT, DOH Case No: 2013-06135 Informal Hearing, (PCP – Fields and Barrett) Respondent was present and sworn in by the court reporter. Ms. Gilani summarized the case for the Board. Respondent was charged with the following violations: Count 1: Section 468.365 (1) (x), through a violation of Section 456.072(1)(w) Florida Statutes (2003), for violation of any provision of this chapter or chapter 456. no board, within 30 days after the licensee has been convicted or found guilty of, or entered a plea of nolo contendere to a crime, regardless of adjudication. The case was presented as a Hearing Not Involving Disputed Issues of Material Fact, which requires the Board to impose whatever discipline upon the Respondent’s license that the Board deems appropriated and to assess costs of the investigation. Respondent was not present nor represented by Counsel. Ms. Gilani summarized the case for the Board. Respondent was charged with the following violation: Section 456.365 (1)( i), Florida Statutes by violating a lawful order of the Board previously entered in a disciplinary hearing. The case was presented as a Hearing Not Involving Disputed Issues of Material Facts and determination of Respondent’s waiver of right to request an informal hearing by default.

MOTION: Ms. Nunez made a motion to find that the Respondent was properly served and has waived his right to a formal hearing. The motion was seconded by Ms. Sherrod and carried 4/0. MOTION: Ms. Nunez made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty. The motion was seconded by Ms. Sherrod and carried 4/0. MOTION: Ms. Nunez made a motion to adopt the findings of fact and conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes, as set forth in the Administrative Complaint. The motion was seconded by Ms. Sherrod and carried 4/0. MOTION: After discussion, Ms. Sherrod made a motion to impose the following penalties: • • • •

Reprimand Fine of $500.00 to be paid within 90 days of the filing of the Final Order Costs of $745.42 to be paid within 90 days of the filing of the Final Order Respondent’s license shall be suspended until he complies with the terms of the Final Order entered in case number 2011-21004 and current Final Order.

The motion was seconded by Dr. Friday-Stroud and carried 4/0. MOTION: Ms. Nunez made a motion to access the costs of $745.42 to be paid within 90 days of the filing of the Final Order. MOTION FOR BOARD’S FINAL ORDER BY VOLUNTARY RELINQUISHMENT OF LICENSE TAB 5 Kathy Elizabeth Winters, RRT, DOH Case No: 2011-14801 Voluntary Relinquishment, (PCP – Fields and Nunez) Respondent was not present nor represented by Counsel. Ms. Gilani summarized the case for the Board. Respondent was charged with the following violation: Section 468.365 (1)(w), Florida Statutes,(2010-2011) by being unable to deliver respiratory care services with reasonable skill and safety to patients by reason of illness or use of alcohol, drugs, narcotics, chemicals, or any other type of material as a result of any mental or physical condition. The case was presented as a motion of Board’s Final Order by Voluntary Relinquishment. MOTION: After discussion, Dr. Friday-Stroud made a motion to accept the Voluntary Relinquishment. The motion was seconded by Mr. Hendriksen and carried 4/0. TAB 6 Silvia Perez, RRT, DOH Case No: 2014-07296 Voluntary Relinquishment, (PCP - Waived) Respondent was not present nor represented by Counsel. Ms. Gilani summarized the case for the Board. 64B32-4.001 Fees. (1) The biennial renewal fee for licensure shall be $120.00 $121.00. (2) The reactivation fee for activating an inactive license shall be $50. (3) The renewal fee for renewing the inactive status of a license shall be $50. (4) If a licensee wishes to request the Board or the Department to provide a duplicate license for replacement of a lost or destroyed license, the Board will issue the duplicate if the request is in writing and accompanied by a payment of $25. (5) In addition to all other fees collected from each licensee, there shall be a $5.00 fee collected upon license renewal for the purpose of combating unlicensed activity. (6) The delinquency fee shall be $120.00. (7) The change in status fee shall be $35.00. (8) The retired status fee shall be $50.00. MOTION: Dr. Friday-Stroud made a motion to accept the revised draft language and directed counsel to proceed with rulemaking procedures. The motion was seconded by Ms. Sherrod and carried 5/0.
