The Board will hold a discussion entitled, “Future of Respiratory Licensure in Florida, within Statutory Guidelines” at 1:00 p.m. Any agenda items not considered before 1:00 p.m., will be addressed after this discussion. Dr. Polles was present on behalf of the Professionals Resource Network, Inc. (PRN). To accommodate individuals wishing to address the Board, the Board Chair may adjust the sequence of the agenda items. The minutes reflect the actual sequence of events rather than the original agenda order. Due to participation in the Probable Cause Panel, Mr. Frey was recused from tabs 1, 3 and 6. Mr. Broeker is recused from tab 4 and Mr. Garcia is recused from tabs 2 and 5.

DISCIPLINARY PROCEEDINGS MOTION FOR BOARD’S FINAL ORDER BY SETTLEMENT AGREEMENT 1.

Respondent was not present nor represented by Counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violation: Section 468.365 (1)(x), Florida Statutes (2015), through a violation of Section 456.072 (1)(c), Florida Statutes (2015), by violating provisions of this chapter or chapter 456, or any rules adopted, by being convicted or found guilty of, or entering a plea of guilty or nolo contendere to a crime. MOTION: After discussion, Mr. Colon made a motion to table this case until the next regularly scheduled business meeting. The motion was seconded by Dr. Friday-Stroud and carried 4/0. MOTION FOR BOARD’S FINAL ORDER BY HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT AND DETERMINATION OF RESPONDENT’S WAIVER OF RIGHT TO REQUEST A FORMAL HEARING 2.

Respondent was not present nor represented by Counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violations: Section 468.365 (1)(x), Florida Statutes (2015), through a violation of Section 456.072 (1)(hh), Florida Statutes (2015), by being terminated from a treatment program for impaired practitioners, which is overseen by an impaired practitioner consultant as described in s. 456.076, for failure to comply, without good cause, with the terms of the monitoring or treatment contract entered into by the licensee, or for not successfully completing any drug treatment or alcohol treatment program. The case was presented as a Hearing Not Involving Disputed Issues of Material Facts and determination of Respondent’s waiver of right to request an informal hearing by default. MOTION: Dr. Friday-Stroud made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact and conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes, as set forth in the Administrative Complaint. The motion was seconded by Mr. Colon and carried 5/0. MOTION: After discussion, Dr. Friday-Stroud made a motion to impose the following penalties: • • •

Reprimanded Fine of $250.00 to be paid within one year of the filing of the Final Order. Costs of $770.33 to be paid within one year of the filing of the Final Order.

The Respondent’s license to practice respiratory care in the State of Florida shall be SUSPENDED until she has been determined to be safe to practice by the board. Such demonstration of skill and safety shall include an evaluation by the Professionals Resource Network (PRN). The Respondent’s license shall remain suspended until he is in compliance with all terms and conditions of PRN recommendations and the Board shall make the determination of whether Respondent is safe to practice respiratory care with reasonable skill and safety.

The motion was seconded by Mr. Colon and carried 5/0. 3.

Respondent was not present nor represented by Counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violation: Section 458.365 (1)( w), Florida Statutes (2016), for being unable to deliver respiratory care services with reasonable skill and safety to patients by reason of illness or use of alcohol, drugs, narcotics, chemicals, or any other type of material as a result of any mental or physical condition. The case was presented as a Hearing Not Involving Disputed Issues of Material Facts and determination of Respondent’s waiver of right to request an informal hearing by default. MOTION: Dr. Friday-Stroud made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact and conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes, as set forth in the Administrative Complaint. Respondent was charged with the following violation: Section 468.365(1)(i), Florida Statutes (2016), by violating a lawful order of the board or department previously entered in a disciplinary hearing. MOTION: After discussion, Mr. Colon made a motion to require Ms. Roland make a personal appearance at the next scheduled Board meeting. The motion was seconded by Dr. FridayStroud and carried 5/0. 10. Rob Casey Souza, Registered Respiratory Therapist Mr. Souza was not present not represented by Counsel. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. On June 27, 2017, Mr. Souza sent a request asking to table his application until the October 6, 2017 Board meeting. MOTION: After discussion, Mr. Frey made a motion to require Mr. Souza make a personal appearance at the next scheduled Board meeting. The motion was seconded by Mr. Colon and carried 5/0. 11. James Lee Cornett, Registered Respiratory Therapist Mr. Cornett was present and sworn in by the court reporter. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Ms. Friday-Stroud made a motion to grant licensure with no conditions. The motion was seconded by Mr. Colon and carried 5/0. 28.

Ms. Dupont was present and sworn in by the court reporter. She was requested to appear before the board due to the personal and disciplinary history found within the processing of her application. MOTION: After discussion, Dr. Friday-Stroud made a motion to grant licensure with the following conditions: •



The applicant shall make contact with the Florida Professionals Resource Network (PRN) within 30 days, undergo an evaluation coordinated by PRN within 60 days of the filing of the Order and if recommended, comply with any and all terms or conditions imposed by PRN within 90 days of the filing of the Order as a result of said evaluation. Staff may issue license if PRN deems applicant safe to practice.

RULE DISCUSSION AND/OR DEVELOPMENT 19. 64B32-2.001, F.A.C., License by Endorsement • Review of Revised Licensure Application Chapter 456, F.S., provides for uniform standards across multiple professions. Therefore, licensure applications for the various professions, have traditionally had many questions in common. To improve efficiency and ensure uniformity, a unified Department application has been developed for the common requirements. Motion: After discussion, Dr. Friday-Stroud made a motion directing Board Counsel to open Chapter 64B32-2.001, F.A.C., for rule development. The motion was seconded by Mr. Frey and carried 5/0. MOTION: Dr. Friday-Stroud made a motion to find the proposed revisions do not have an adverse impact on small businesses and will not be likely to increase regulatory costs directly or indirectly to any entity (including government) in excess of $200,000 in the aggregate in Florida within 1 year after the implementation of the rule. The motion was seconded by Mr. Colon and carried 5/0. MOTION: Dr. Friday-Stroud made a motion to find the proposed affected cumulative changes would not be to increase regulatory costs to any entity (including government) in excess of $1,000,000 in Florida within the next 5 years after the implementation of the rule. The motion was seconded by Mr. Mr. Frey and carried 5/0. MOTION: Mr. Colon made a motion that a violation of this rule, or any part of this rule, does not constitute a designation of a minor violation. The motion was seconded by Mr. Frey and carried 5/0. 20. 64B32-6.007, F.A.C., Continuing Education Requirements for Reactivation of License 64B32-6.007 Continuing Education Requirements for Reactivation of License. The continuing education requirements for reactivation of a license shall be: (1) Those requirements specified in Section 456.036(11)(10), F.S.; and (2) Documented proof of completion of 24 hours of approved continuing education as provided in this rule chapter and medical error prevention, for the preceding biennium during which the license was inactive;licensee held an active license and (3) Documented proof of 12 hours of approved continuing education as provided in this rule chapter for each year the license was inactive. Specific Authority 456.036, 468.353 FS. Law Implemented 468.363 FS. History–New 10-11-04, Amended 6-21-07, 7-14-17. Motion: After discussion, Mr. Frey made a motion to approve the proposed language, directing Board Counsel to open Chapter 64B32-6.007, F.A.C., for rule development. New Continuing Education Providers MOTION: Mr. Broeker made a motion to ratify the one name (Exhibit C), FSU College of Medicine AHEC, for continuing education provider-ship for Florida respiratory care courses. The motion was seconded by Mr. Frey and carried 5/0. 15. Exemption from Disqualification Ratification List MOTION: Mr. Frey made a motion to ratify the one name, Albert E. Jones (Exhibit D), for exemption for disqualification from employment by delegation of authority from the Board for staff to administratively review and approve exemption applications that meet certain criteria. Mr. Hall provided a brief explanation on how to report unlicensed activity. Informational only. 17. Equipment Deliveries The Chair requested a discussion on drivers for Home Health Care Companies and activities they perform when they deliver equipment related to respiratory services. Mr. Hall addressed the Board and provided information pertaining to the statutes surrounding equipment deliveries. Mr. Dennis Willerth, Executive Director, Florida Society for Respiratory Care, addressed the Board. The Board would like a representative from the Unlicensed License Activity Unit with the Department of Health to attend the next regularly scheduled board meeting in October 2017, for further discussion. 18. Annual Regulatory Plan Each agency under the direction of the Governor shall submit to the Office of Fiscal Accountability and Regulatory Reform (OFARR), an annual regulatory plan that shall identify and describe each rule that the agency expects to begin promulgating during the next twelvemonth period. In general, the plan should include any rules the board/council plans to amend during the upcoming year. Staff recommends that all application rules be added to the plan as changes to the application are often needed and cannot always be anticipated. If a rule is not included and a subsequent need to change the rule arises, the board/council is not prohibited from making needed changes, conversely simply placing a rule on the plan does not require rule development be undertaken. It is suggested the board/council delegate to the Chair the authority to approve the plan completed by the attorney subsequent to this meeting. MOTION: After discussion, Mr. Colon made a motion to delegate authority to the Board Chair to work with the attorney in executing a plan for the respiratory care board. Future of Respiratory Licensure in Florida, within Statutory Guidelines

Mr. Frey opened the discussion regarding the Boards roles and authority of the Board. He summarized the discussion that was held during the April 6, 2017 meeting. Mr. Colon addressed the Members and the public regarding the licensure of a Certified Respiratory Therapist (CRT) and a Registered Respiratory Therapist (RRT) and expressed interest in putting forth legislative language to moving towards a singular license. Individuals from the public were permitted to address the board. Among these individuals were, Kim Gibson, Edward Scully, Terry Suarez, Rashanda Shewright, Carlos Mejia, and Dennis Willerth. Mr. Colon proposed to continue the conversation at the next scheduled Board meeting to begin at 1:00 p.m. The Board would like further information on how to move forth with legislative language. Mr. Hall provided the steps of how to submit proposed legislative language. With no further discussion, the meeting was adjourned at 2:41 p.m.
