Patagonia and Others File Lawsuit Against President Trump Over Bears Ears

In an anticipated move, Patagonia has filed a lawsuit against President Trump over his decision to remove over 2 million acres of land from Bears Ears and Grand Staircase-Escalante national monuments earlier this week. The lawsuit, filed with a coalition of other outdoor groups, Native Americans, paleontologists and others, was officially filed in federal court in Washington D.C. on Wednesday. The plaintiffs include Patagonia Works, Utah Diné Bikéyah, Friends of Cedar Mesa, Archaeology Southwest, Conservation Lands Foundation, Access Fund, the Society for Vertebrate Paleontology and the National Trust for Historic Preservation.

They argue that President Trump’s proclamation on Monday is illegal, ignores public support for the monuments and dishonors Native American tribes in that area. As stated in a press release announcing the lawsuit: “Sixteen presidents have used the Antiquities Act to designate 157 national monuments since 1906 to preserve our unique and treasured places from destruction. President Trump’s proclamation is the first time any president has attempted to abolish a monument established by a previous president and amounts to the largest elimination of protected areas in American history. By revoking national monument status for 85 percent of the area protected by the Bears Ears National Monument, President Trump has removed legal protections for many well-known and widely-revered historic, scientific and cultural areas.” Two other lawsuits by separate groups with similar intentions have also been filed against President Trump since the decision, as we covered on Tuesday. Patagonia has certainly been outspoken from the start of President Trump’s call to Secretary of the Interior Ryan Zinke to review 27 national monuments. From helping lead the movement to name Bears Ears a national monument to producing a film on Bears Ears to donating to local groups to organizing people and groups opposed to shrinking the national monuments, the outdoors company has put themselves at the forefront of this issue. And Patagonia founder Yvon Chouinard has not minced words on his feelings on this subject. In an interview with CNN released earlier this week, Chouinard stated that he planned to sue President Trump if he attempted to shrink Bears Ears: “I think the only thing this administration understands is lawsuits. We’re losing this planet, and we have an evil government. And not just the federal government, but the whacko politicians out of Utah. I’m not going to stand back and let evil win.”

The Administration’s unlawful actions betray our shared responsibility to protect iconic places for future generations and represent the largest elimination of protected land in American history.
