The proposed use was approved by the City Planning Commission pursuant to New York City Charter Section 195 on February 3, 2016 (CPC Appl. No. N 160131 PXX, Public Hearing Cal. No. 10). The proposed lease shall be for a period of ten (10) years from September 1, 2019, at an annual rent of $2,324,006.60 for the first (1) year, increasing at a cumulative two (2%) percent per annum, payable in equal monthly installments at the end of each month. The Tenant shall have the one time right to terminate the lease after the eighth (8th) anniversary of the lease term on twelve (12) months prior written notice. If the lease is terminated by the Tenant, the Tenant shall reimburse the Landlord for the unamortized cost over ten (10) years of the Tenant’s representatives’ commission. The Tenant shall have three (3) options to renew the lease for periods of five (5) years at 95% of the Fair Market Value rental for the initial year of each renewal term, but not less than the final annual rental applicable to the last year of the preceding term or renewal period, increasing 2% per annum compounded for the third (3rd), fourth (4th) and fifth (5th) years of each renewal term.
