TERMS AND CONDITIONS 1.

The Application is made by the Applicant(s) requesting for allotment of the unit in the project as mentioned above.

2.

Along with the application, a sum of Rs. …………………../- (Rupees …………………………….. only) being the minimum amount as booking / earnest money is paid.

3.

The application will be processed by SL after the realization of the booking amount.

4.

Subject to availability of the unit, SOBHA Limited (SL) will either issue the allotment letter in acceptance of the application or reject the same.

5.

The Applicant(s) hereby confirm that they have prior knowledge of the project by visiting the project site / collaterals available at the project site and/or collating information from SOBHA website and/or visiting to the website for the project with Regulatory Authority under RERA and is / are satisfied with the information furnished.

6.

Upon payment upto 10% of the cost of unit, the Applicant must execute the Agreement for Sale for the unit booked. If the Applicant(s) fail to execute the Agreement within a period of 30 days from the date of receipt of the Agreement by any of Applicant(s) and / or fail to appear before the sub-registrar for its registration (if applicable), then SL serve a notice to the applicant(s) for rectifying the default and if not rectified within 30 days of receipt of such notice the allotment letter for the unit will be treated as cancelled and the amount paid by the Applicants, (excluding GST charged), will be returned within 60 days the refund becomes due.

7.

The stamp duty and registration charges (if applicable) payable for the Agreement for Sale (AFS) as applicable from time to time shall be borne by the Applicant.

8.

The Applicant(s) will not question the sale price of any other unit purchaser nor will the Applicant(s) be entitled to compare the same with the other unit purchasers.

9.

The Applicant(s) has/have been made available the sanction of plan, payment schedule/construction time schedule and specifications etc. for the Project/Phase, in which the Applicant(s) has/have been allotted the unit.

10.

Notice sent to the First Applicant at the address given by the Applicant(s) in the application shall be sufficient notice to co-applicant(s).

11.

Applicant(s) shall sign at the bottom of all the pages of this form.

12.

The applicant(s) confirm that he/she/they have understood the scheme of development and aware of the surrounding area and the neighbourhood of the project site.

13.

In case of default by allottee for making payments as per the payment schedule for a period beyond consecutive two months, a notice from SL will be issued to pay the amount with interest and failure to pay the amount of instalment, the allotment letter stands cancelled.

14.

If the allottee cancel or withdraw from project without any fault of SL or valid reasons, SL is entitled to forfeit the booking / earnest amount paid by the applicant(s).

15.

The Garage / covered car park(s) location will be identified / communicated by SL to the Applicant(s) only after the completion of the project.

16.

No transfer of assignment of unit will be allowed until the applicant executes the Agreement for Sale. Any transfer of assignment will be as per the final signed agreement.

17.

The content of the Show Unit (Mock apartment) are not part of the representation nor part of the sale or specifications, and the same is for enabling the purchaser to estimate and gauge the space available on placing any such items in the apartment / unit proposed to be purchased.

18.

Request from the Applicant(s) for shifting from one unit to another unit either in the same or another project will be entertained by SL at its sole discretion.

19.

The Applicant(s) agree that in case SL decides not to go ahead with the project for any reason whatsoever (other than force majeure), such decision shall be final and binding and cannot be disputed by the Applicant(s). In such an event, SL will refund the amount paid by the Applicant(s)/allottee(s) with applicable interest (excluding GST charged) within 60 days from the refund become due.

20.

The Applicant(s) agree that in case SL is not able to go ahead with the project due to force majeure, in such an event the allottee agrees and confirms that this allotment shall stand cancelled and SL shall refund to the allottee the entire amount received without any interest (excluding GST charged) within 60 days from the refund becomes due.

21.

The Applicant(s) agrees that in case the SL, due to any statutory, regulatory/government reasons, is unable to construct / continue to construct or complete the construction, either fully or any part of the building/project, which is not attributable to the fault of the SL, in such an event, SL shall give a choice to the Applicant(s) to select any other available unit in the same project or any other project. If the Applicant(s) decides not to select an alternate unit, and chooses to cancel this application / allotment of the unit, then SL shall refund the amount paid by Applicant(s) till the date of termination without any interest (except GST charged) within 60 days from the refund becomes due.

22.

SL has no control on all the developments that may exist or take place in future whatsoever, in the adjoining property of the project.

23.

All columns in the application form need to be filled completely. Incomplete application forms will be rejected.

24.

It is the sole responsibility of the Applicant(s) to provide their updated personal information (if any) to SL from time to time.

25.

All the communication sent by SL to Applicant(s) at the address given above, either by e-mail or by any other form of communication, shall be deemed to have been received by the Applicant(s). SL shall continue to correspond with the Applicant (s) at the address mentioned in the Application unless the change of the address is given in writing or entered in the customer portal CRM module and such changed address is confirmed by SL. Any such communication returned to SL for whatever reason, is deemed as received by the Applicant(s) and the Applicant(s) agree(s) to abide by the content of such communication.

26.

The Applicant(s) agree that only written and signed commitments by an authorized personnel of SL, not below the rank of Vice President in the Sales, Marketing and CRM departments, will be honoured.

27.

SL has the right to conduct a Know Your Customer (KYC) verification of the Applicant(s) by an authorized employee based on the information provided in the application form.

28.

The Application Form is not transferable.

29.

Any clarifications on any issues till the signing of the Agreement for Sale, may be referred to the Vice President-Sales.

30.

All disputes relating to / arising out of this Application Form are subject to the exclusive jurisdiction of Courts in Bangalore.

TDS AUTHORISATION OPTION As per Section 194-1A of the Income Tax Act, 1962 the Buyer/s is/are required to deduct an amount equals to 1% on the property transaction more than Rs.50 Lakhs and deposit the same to the IT Department. The Buyer/s is/are required to furnish Form 26QB and Form 16B duly signed mentioning the details regarding the property purchased & TDS deduction. To extend this help to the Applicant/s SL has provided Two Options as mentioned below: Option 1: 100% payment is made by the Customer and SL will deduct 1% TDS on Customer’s behalf (only Primary Applicant) and remit the Tax thus deducted to the Government. SL will provide the Challan paid Receipt. The Customer download Form 16B from IT website and submit duly signed copy to SL within 15 Days of receiving Challan paid receipt. Option 2: Applicants are requested to deduct 1% TDS and remit the same to Government as per the IT law. Applicants are required to submit Form 26QB and signed copy of Form 16B within 15 Days of payment. I/ We agree for Option:1
