1991, 1988, 2012, 2121, 2114 Circle K which is located at 814 W. Washington St., informed this department of a problem between a black male and a black female arguing on Lawrence St. just south of W. Washington St. When I arrived in the area, I heard loud screaming and I observed a large group of subjects in the roadway on Lawrence St. at W. Adams St. When I activated the emergency lights, the group began scattering in different directions. I began noticing a black male wearing a white tank top walking away from everyone on the sidewalk headed south. Ashley Fisher and Michael Mcglothlin began yelling at me that the male I observed wearing the white tank top punched a female. I got back into my cruiser and I got ahead of the male I ordered him to stop with him complying. The male was identified as Jonathan Lacey and he told me that he was just trying to go home. Jonathan stated that he did not know any of the subjects who were yelling at him and he did not touch anyone when I asked him if he punched a female. Jonathan stated that the group began trying to start problems with him at Circle K and he was just trying to go home. I then informed Jonathan that I was being told that he had also thrown beer on a 17 year old female identified as Nayutica Grant. Jonathan denied throwing beer at Nayutica. As I spoke with Jonathan, I detected a strong odor of intoxicants on or about his person. Jonathan was noticed to have slurred speech and glassy eyes. I informed Jonathan that I was placing him under an investigative detention until the matter could be determined whether or not he had assaulted anyone. Jonathan was seated in the back seat of my cruiser S-3 after I conducted a pat down of his person to make sure he did not have any weapons. No weapons were located. I spoke with Ofc. Desalle and Ofc. Smith. Ofc. Desalle and Ofc. Smith had spoken with Ashley Fisher, Nayutica Grant, and Tashyra Porter. I was told that everyone was in the Circle K parking lot when an argument began. Jonathan kept trying to talk to Nayutica as she began walking south from Circle K away from Jonathan. When Nayutica refused to talk to Jonathan, he threw a cup of beer at Nayutica. Nayutica began yelling at Jonathan for throwing the beer on her clothes at which time Tashyra began trying to intervene to get Nayutica to walk away. Micheal McGlothlin then got in between Jonathan, Nayutica, and Tashyra because he was trying to protect his family members as the argument was becoming heated. When Michael turned his head away from Tashyra, Jonathan struck Tashyra on the left side of her face knocking off her glasses onto the roadway. Michael then yelled for other uninvolved family members to get Ashley because Tashyra had been assaulted. When Ashley arrived at the corner and she learned Tashyra was struck in the face and Nayutica had beer thrown on her clothes, Ashley decided to contact the police for assistance.

I spoke with Michael and I asked him to explain in his words what happened. Michael told me that he was with Nayutica and Tashyra in the Circle K parking lot. Jonathan overheard Nayutica make a comment that Jonathan did not like and he began questioning her about the comment. When Nayutica answered Jonathan, he threw a cup of beer at Nayutica's clothes. Michael said he did not want any problems so he decided to have Tashyra and Nayutica start walking. Jonathan began following them south on the sidewalk from Circle K. Michael kept trying to keep Jonathan away from Tashyra and Nayutica by extending his arms. Michael and Jonathan touched arms and they began arguing with Tashyra also getting involved. As Michael tried to keep everyone from fighting, Michael turned his head and Tashyra was struck on the left side of her face knocking off her glasses. Michael yelled for other family members to get Ashley who then contacted this department. When I questioned Jonathan again, he kept telling me that he did not touch anyone and that he was being swarmed by several people for no reason. It was learned that Ashley did not desire assault charges against Jonathan for hitting Tashyra since she did not have any visible marks. I informed Jonathan he would not be charged with the assault, but I believed that he was intoxicated and I believed that he provoked the incident by throwing beer at Nayutica. I requested Jonathan submit to a PBT to determine the level of intoxication and he did so voluntarily. The result of the PBT showed .156 BAC. I informed Jonathan he was being charged with disorderly conduct while being intoxicated and he needed a responsible party to take care of his well being. I transported Jonathan to a sober person who then signed a responsibility form for his well being and he was released after being served with a summons for the charge listed below. At this time, no further action needed to be taken and I returned to service. ARRESTED : Jonathan Lacey Disorderly Conduct while Intox - 2917.11B2 (MM) - Summons / Released to sober party Ofc.
